DECISION On March 23, 1971, the Atomic Safety and Licensing Boa d r convened to preside in this proceeding rendered an inicial decision authorizing the issuance of a construction permit to the Tol d e o Edison Co. and the Cleveland Electric Illuminating Co. (applicants) for a pressurized water nuclear power reactor.
The new facility, designed to operare at 2633 MW(thermal), with ultimate capability of produci ng 2772 MW(thermal),
is to be located on the south shore of Lake Erie i 20 miles n Ottawa County, Ohio, east of Toledo.
Exceptions to the initial decision were filed sepa rately by Coalition for Safe Nuclear Power (Coalition)
, and by Living in a Finer Environment and William E. Reany (jointly referred to as LIFE), all of whom were intervenora in the proceeding before the Licensi ng Board.
The applicant has filed a response to the exceptions of both the Coalition and - LIFE, and the regulatory ataff has fil d e
separate responses to these exceptions.

tions, LIFE has characterized all of its exceptions as being based on the Licensing Board's alleged failure to comply with requirements of 1
the National Environmental Policy Act of 1969 (NEPA). The first five I
of the six exceptions asserted by the Coalition also relate to the i
Board's disposition of questions arising as a result of NEPA.
The exceptions involving NEPA raise the question of the applica-bility to this proceeding of the recent holding of the United States j

"In view of the paramount interest in conducting a fair and orderly proceeding, whether under the circum-stances of this case the definition of the Board's authority, as set forth in its order, is compatible legally with authority granted to the Director of Regula tion."
This referral presents the question of whether the Director of Regulation is authorized to grant, after the hearing hss commenced, an exemption permitting an applicant to perform certain construction work.
The question was referred to the Appeal Board following a Licensing Board order to the Director of Regulation (as a party) not to issue an amendment, as sought by applicant's letter of January 7, 1971, al to the previously granted exemption until the Board had filed its initial decision.
The Director of Regulation took no action to grant such an amendment to the exemption.
The Appeal Board has considered the question referred by the Licensing Board, including the reasons set forth by the Licensing Board for reaching its conclusion, the motion and legal memorandum filed by LIFE on this question, the affidavit filed by the applicant, and the oral argument as reflected in the transcript.
The ultimate resolution of the question depends upon the scope of the Commission's delegations of authority to the Director of Regulation and the Licensing l

We appreciate the care with which the Licensing Board has construed applicable Commission regulations and delegations of authority, some of which may appear to be inconsistent eith others.
As a result of our review, however, we conclude that a more persuasive construction of the regulations, and one which we believe represents the intent of the Commission, as we infer that intent from the manner in which exemptions have been handled for several years, is that the Commission has not delegated to Licensing Boards the authority to grant or take action with respect to exemptions, but instead has generally conferred such authority on the Director of Regulation.
In the context of this case, we note first that the question became moot on March 23, 1971, with the issuence of the construction permit.
But we also note that the Director of Regulation deferred action on the requested amendment to the exemption. Under the circumstances of this El case, we view that result as proper.
We note that the Commission indicated its concurrence in this result in the Chairman's letter of March 18, 1971, to Congressman John D. Dingell, which has been included in the record of this proceeding.
Finally, we believe that as a general matter, exemptions have not been granted after hearingr$ have commenced.

In this connection we observe dat the Licensing Board might have been saved a great deal of time in its efforts to harmonize the various provisions of the Commission's regulations, and the public would have better understood the Commission's position in regard to exemptions, if the regulatory staff had informed the Licensing Board that under the circumstances of this case action on the request for
-exemption had been deferred.
