NORTHERN INDIANA PUBLIC SERVICE COMPANY'S RESPONSE TO CONTENTION 13 Porter County Chapter Intervenors (hereinaftir "PCCI")

have served a document entitled " Porter County Chapter Inter-venors' Contention Concerning NIPSCO's Letter of November 26, 1980." The document is in the nature of a motion to admit a

" late-filed" contention and Northern Indiana Public Service Company (NIPSCO) files this response thereto.

NIPSCO does not object to admission of the first para-

graph of " Contention 13."- NIPSCO does not thereby admit that the contention has any validity.

However, NIPSCO opposes the admission of the second para-

graph of Contention 13.- The first sentence is simply wrong.

Contrary to PCCI's allegation, there is no ambiguity regarding the requested latest date for completion of construction. Mr.

Shorb's letter of November 26 states clearly that NIPSCO requests that the latest date for completion be extended to December 1, 1989. (Letter, final paragraph.) The language cited by PCCI is obviously an explanation of how that date was determined; i.e., the identification of a date for starting the estimated construction period. In view of this error, the second sentence seeks to raise an issue which is irrelevant.

The final sentence of the second paragraph repeats an

assertion made in the first paragraph-- and st.Les the legal conclusion that "NIPSCO's request should therefore be denied."

For the foregoing reasons, the second paragraph of Conten-tion 13 should not be admitted.
