Dear ifr. Gross:

Your Freedom of Information Act (F0IA) request of August 16, 1979, for the General Electric " Reed Report" and its abstracts was responded to by Mr. Sheldon J. Wolfe on August 31, 1979.

The purpose of this letter is tc, provide you with the current status concerning the General Electric (GE)

"Re.td Report."

In the past several months, the Comission reviewed GE's proprietary claim under exemption 4 of the F01A.

The Commission was evenly divided on whether to withhold the Report.

Copies of the Commission's memoranda concerning this matter are enclosed. On October 17, 1980, GE filed suit in Federal District Court to enjoin. disclosure of the report.

The Federal District Court has ordered NRC not to disclose the report pending the resolution of the various claims.

We will keep you advised as to the status.
