Gentlemen:
This is in reference to the two letters dated July 22, 1980, from the Law Offices

of Sutin, Thayer and Browne, Albuquerque, New Mexico, in response to the Notice of Violation'.and Notice of Proposed Imposition of Civil Penalties sent to you with our letter of June 27, 1980. This also acknowledges receipt of the payment of Four Thousand Two Hundred Dollars with' respect to the proposed penalties for items 1, 3, 5, 6, 7, 8 and, one-half of the amount proposed for item 4 ($500),
'as indicated in the June 27, 1980 Notice of Violation.
After careful consideration of the July 22, 1980 responses, in which mitigation was requested for the full amount of the proposed civil penalty for alleged item No. 2 and for one-half of the amount proposed for alleged item No. 4, we have concluded for the reasons given in the enclosed Order that the items of noncom-pliance did occur as set out in the Notice of Violation, and that civil penalt-ies should be imposed as proposed in the Notice of Proposed Imposition of Civil Penalties.
Accordingly, we hereby serve the enclosed Order on Nuclear Pharmacy, Incorporated in the amount of One Thousand Dollars for item 2, and an additional Five Hundred Dollars for item 4, for a total of One Thousand Five Hundred Dollars.
i We have reviewed the corrective action for each of the items of noncompliance set l
forth in the July 22, 1980 letter. We have no further questions on these matters at present. We plan to review your corrective actions during subsequent inspec-tions of your activities under your NRC license.
