AMENDED NOTICES OF VIOLATION By EN-80-31, dated July 3,1980, the Comission was notified of the intent of IE to issue a Notice of Violation and a Notice of Proposed Imposition of Civil Penalties in the amount of Thirteen Thousand Dollars to Boston Edison Company M/C Nuclear. This action was based on alleged items of noncompliance which involved (1) exceeding Limiting Condition of Operation when irradiated fuel was moved without secondary containment integrity; (2) refueling activities performed in violation of authorized procedures; and (3) the auxiliary electri-cal system; including emergency power, aligned in a condition not prescribed by plant procedures. A Notice of Violation was also sent to a licensed Senior Reactor Operator.
The Notices were mailed on July 8, 1980.
Boston Edison Company and the Senior Reactor Operator responded by letters dated August 1,1980.
In consideration of the responses, amended Notices of Violation have been issued today to Boston Edison Company and The Senior Reactor Operator. The licensees and the Commonwealth of Massachusetts are being informed by telephone.
Since this matter has been the subject of a previous NRC news release, no addi-tional release is planned. The Office of Public Affairs will respond to inquiries as received.
The licensees have 25 days from the date of the Notices to respond.
Following NRC staff evaluation of the Boston Edison Company response the civil penalties may be remitted, mitigated or imposed by order.
