IMPOSITION OF CIVIL PENALTIES - $48,000 By EN-80-37, dated August 14, 1980, the Commission was notified of IE intent to issue a Notice of Violation and Notice of Proposed Imposition of Civil Pencities in the amount of Forty-eight Thousand Dollars to the Power Authority of the State of New York. The proposed penalties were based on alleged items of noncompliance associated with the implementation of the Fitzpatrick Physical Security Plan.
The Notices were mailed on August 18, 1980, and the licensee responded by letter dated September 12, 1980. After consideration of the licensee's response, the IE Staff concluded that the items of noncompliance did occur and no idequate reasons were given by the licensee for mitigation or remission of the proposed penalties. Accordingly, an Order imposing civil penalties in the amount of Forty-eight Thousand Dollars has been issued today.
The licensee and the State of New York will be notified by telephone.
Since this matter was the subject of an NRC news release, no additional release is planned. The Office of Public Affairs will respond to inquiries as received.
Under the terms of the Order, the licensee may, within twenty-five days of the date of the Order, pay the civil penalties or request a hearing.
