CASE'S MCTION FOR EXTENSION OF TIME TO SUFFLEMENT RESPONSE TO APPLICAICS' MOTION TO COMPEL; AND MOTION FOR PROVIDING 1

NRC ISSUANCES -

l As soon as CASE received Applicant's Motion to Compel filed September 18, 1980,.ve began-formulating our response, which was filed on October 2, 1980.

We also began at that time to try to locate in this area the decisions referenced in Applicants' Motion, with.the idea that we might wish to supplement in short order our_ response to Applicants' Motion after having reviewed those decisions.

- Tnere were.also some decisions referenced by. the NRC Staff in it.; Answer to Appli-cants' Motion to Compel ACORN, filed October 2,1980, which we wanted to review.

However, after much leswork and long-distance telephone calls, we found that there apparently is not available anywhere in this area the ASL3 and Appeal Board decisions (NRC-Issucnces) for the years 1978 and 1979 and nothing available for' 1980 after June and only Indexes for January and February. This was the case

On October 9, CASE caned the NRC Public Document Room and requested that 1

! they copy and send r,he specific sitings we had been unable to find and bill us l i for them. After CASE found that these NRC Issuances were anavailable at all I cellege and state libraries and NRC Offices in Texas of which CASE is aware within a

reasonable distance of this Intervenor, CASE felt .it imperative to make the follow-t ing motions:

That the Board allev CASE 10 days' additional time in which to supplement 1

our response to Applicants' Motion to Compel after we have received the l specific items ordered from the NRC Public Docunent Roca on Octcber 9; j

2. That the Board have copies of the 1978,1979, and^1980 'on (as they beccr.e available) NRC Issuances r.ade available at the University of Texas at This would provide access
