"I'm calling on a very limited matter and I'm addressing this to Messrs. Doherty, Scott, Newman and Black in order to alert them as to an order being issued today that only affects them, and not the other parties.

That's the reason why I haven't gotten all the other parties 1

in on this conference call; but, of course, the memorandum being made of this conversation will be served on all parties and certainly the order being issued today speaks for itself.

But, I would remind the parties on the conference call that I will not discuss other matters since all of the other parties are not participants in this conference call.

So, I would advise the parties on the phone that our order of today rules in pertinent part, first, that Mr. Doherty's September 15, 1980 motion for additional time to answer Applicant and Staff's motions for summary disposition is granted in part, and denied in part.

Mr. Doherty is to have until November 4, 1980 to serve the remainder of his replies to Applicants and Staffs motions for summary disposi-tion."

Mr. Doherty:

" November 4, 1980."

Mr. Wolfe:

"Now, in order to assist the Board in its review, Mr. Doherty shall serve each reply when it's completed.

No further extensions of time will be granted to Mr. Doherty."

" Secondly, with regard to TexPirg's...

Mr. Doherty:

" Alright, sir, then sir I want to J

be sure that you want me to serve each time I complete, you want to serve as soon as possible."

Mr. Wolfe:

"Yes, sir."

Mr. Doherty:

" Alright."

Mr. Wolfe:

" Secondly, with regard to TexPirg's September 12 request for extension of t'ime to file motions for summary disposition, that is granted in part, and denied in part.

TexPirg is to have until October 8, 1980 within which to file its motions for summary disposition.

TexPirg will telephone Applicants Mr. Copeland, who will arrange to secure a copy of the motion or motions, and expedite delivery to Staff counsel; and Applicant and/or Staff shall respond within 20 days after the receipt of TexPirg's motion or motions, and hand deliver the copy of their responses to the Board.

No further extensions of time will be granted to TexPirg."

"So I thought I would alert, particularly, Mr. Scott to that due date, and certainly, Mr. Doherty.

And, that completes my conversation.

Is everything understood by everyone now?"

Mr. Scott:

'"I believe I understand.

I'have until October 8 to file any additional motions for ummary disposi-tion that I might wish to file."

Mr. Wolfe:

"That's right."

"And I take it, since it is not addressed that I do believe that since I did not ask for additional time that tomorrow is the last day for me to respond to the motions that have already been sent to me?"

Mr. Wolfe:

"Is that correct Mr. Newman and Mr. Black?"

"I think that October 2 was the due date for your responding to Staff and/or Applicants, and you didn't ask for an extension of time, so I'm only addressing your September 12 conversation, rather request for extension of time."

Mr. Scott:

"Is it proper to ask over the phone like this for extensions of time?"

Mr. Wolfe:

"I think not, because the other parties should be given time within which to think about your request and to advise the Board.

And the Board in turn, needs time to rule on that sort of request."

Mr. Black:

"I fail to see the relevancy of that request anyway because it is my understanding that neither the Staff nor the Applicant filed motions for summary disposition with respect to any TexPirg contentio'ns, except for that latching contention which TexPirg has already filed a response to."

Mr. Scott:

"I believe Mr. Black is in error.

I'm looking here at six separate motions for summary disposition against TexPirg."

"I think that is right, I think Applicant filed 4 motions fcr summary disposition directed to TexPirg's cont;... ion; I think Staff filed two.

Isn't that correct Mr. Black?"

Mr. Black:

"I might stand corrected, then.

I must hav..

Mr. Newman:

"Mr. Chairman, the way it is stated is accurate."

Mr. Wolfe:

"That completes my phone call but I did want to call the parties affected and give them a leg up and alert them to what the order of today is so that they can get busy doing what they have to do."

Mr. Doherty:

"I see what you have done and I appreciate it."

Mr. Wolfe:

"Yes, Mr. Doherty.

Alright.
