MEMORANDUM AND ORDER (October 1, 1980)

On September 29, 1980 the chairman initiated a telephone _

l conference call with counsel for TMIA and counsel for licensee to discuss TMIA's request for a subpoena duces tecum to licensee's

employee, David Good.-

The request, attached hereto,was not servad.

Counsel for TMIA reported that the only purpose of ca]. ling Mr. Good was for cross-examination on the computer sum-maries covered by the subpoena, not upon work orders as was pro-vided in the board's Memorandum and Order on TMIA Contention 5 (p. 3) of September 24.

As a result the following rulings are required:

Only the remaining nine Metropolitan Edison employees listed on page 3, n. 2 of the September 24 memorandum and order will be cross-examined on work orders, and these persons will be

. cross-examined upon no more than five work orders each on the issue of the alleged pattern of deferred safety-related maintenance.

TMIA will file a trial brief with its other filing due on October 3, 1980 setting out the purpose of TMIA's presentation through Mr. Good.

Counsel for licensee agreed to produce at the hearing at the time of Mr. Good's appearance, the requested documents without a subpoena duces tecum.

Counsel for TMIA promised to examine carefully the board's memorandum and order of September 24, and to report by the afternoon of September 30 whether he requests -

any additional departures from the order.

Counsel had not requested any changes at the close of business on September 30.
