INTRODUCTICN Because of the f ailure of the Commission to 1 grant intervenor funding and the decision of the Board to force TMIA to present its case in chief out of sequence, TMIA cannot present tes timony through its own witnesses. Consequently, TMIA has been forced to present its case by cross-examining Licensee's employees. This approach to the r .I presentation of TMI A's case has been specifically approved in Tennessee Va' tey Authoritv (Hartsville Nuclear) ALAB-463, 7 NRC 341, 346 (1978) and other decisions. II. DISCUSSION A. Deferred Maintenance 1. General 4 Initially, TMIA intends to call employees of Licenseel to describe th e ma jo r sys tens in operation d I J. J. Colitz, Manager, Plant Engineering. 4

~.. at TMI-1 and to identify the components related to these systems. 2. Priority Systems The Licensee had in place a maintenance system for guiding its personnel. TMIA intends to have knowledge-able employees 2 of the Licensee explain this system. 3. Work Requests The work requests reviewed by TMI A and summaries 3 will be introduced into evidence. Employees 4 of Licensee will be called to explain why maintenance items with high priorities were allowed to remain open for long periods of time. In addition, los t work reques ts, work reques ts that were cancelled without ever having been completed and generally inaccurate maintenance records will also be the subjects of cross-examination. B. Proposed Maintenance Cut Employees 5 of Licensee will be called to explain the rationale behind the proposed cu t in the maintenance budget.
