U.S. NUCLEAR REGULATORY COMMISSION REVIEW OF EXPORT LICENSE APPLICATION XB1339

Dear Mr. Al-Nadaf:

I am writing to update you on the status of your export license application (XB1339).

The application is currently under review by the U.S. Nuclear Regulatory Commission (NRC),

for four germanium-68 (Ge-68) kits, each containing one unit of Ge-68 at 92.5 MBq and two units of Ge-68 at 46.25 MBq each. The total activity of each kit is 185 MBq. Title 10 of the Code of Federal Regulations (10 CFR) 110.40(d), states in part, if the Commission has not completed action on a license application within 60 days after receipt of the Executive Branch (EB) judgement, the NRC is required to inform the applicant in writing of the reason for the delay.

This application involves an embargoed destination, the regulatory review is comprehensive, requiring reviews from several technical offices, as well as, the Offices of Executive Director of Operations and Office of the General Counsel. The next review stage is the final review - which is the Commission review.

The NRC received the final EB judgment on June 5, 2019, but additional time is needed for NRC staff and management to complete its review of the export application.
