Dear Mr. Bates:

This is to acknowledge receipt of ycur letter of July 1,1980 requesting the publication of a second Federal Register notice to correct what you regard as

" errors" contained in the Feoeral Register notice issued by this office on June 24, 1980, which had indicated receipt by the Ccmission of your petition of May 23, 1980 and its consideration under 10 CFR Section 2.206.

Ycur first concern is that the use of the word "its" in modifying the term "Sequoyah ccmerical nuclear power plant" might convey the irrplication that the plant belongs to TNRC rather that the Tennessee Valley Authority. We regard this concern as unfounded since the caption of the Federal Register notice makes it clear that the Sequoyah facility is owned by the Tennessee Valley Authority.

Your other concern involves the characterization of TNRC's petition as alleging that the containment of the Sequoyah facility would not withstand pressures resulting from hydrogen explosions. You prefer a cnarac-terization of the effect that the Sequoyah facility could not withstand pressures resulting frem hydrogen explosions. As the Fenral Register notice which was issued fairly apprises the public of the substance of your petition, I must decline your request to issue a second notice.

Discussion:

The notice published in the Federal Register en June 24, 1990 falsely i:nplied that the Sequoyah Nuclear Plant is cwned and and that operated by O.e Nuclear Regulatory Ccesission (OIRC) the petition by the TNRC on May 28, 1950 alleged that the centain:nont at Sequcyah Unit I would not be able to withstand a hydregen burn pressure such as cccured at OC-2. The actica has caused TVA to publicly respond en the basis of these errenicus allegations and should be corrected by republicatien.

TNRC'S REQUEST TO ISSUE A SECOND FEDERAL REGISTER NOTICE RE THE COMMISSION'S CONSIDERATION OF A 2.206 REQUEST CONCERNING THE SEQUOYAH FACILITY On June 24, 1980, your office issued a Federal Register notice indicating receipt of a "The Nuclear Regulatory Commission" (TNRC) petition requesting that the icw j

pcwer operating license authorizing limited operation of the Sequoyah Nuclear Pcwer Plant be revoked.

The notice further indicated that the petition was being treated as a request for action under 10 CFR 2.206.

1 On July 1,1980, TNRC directed a letter to you complaining that the Federal Register notice contained " errors" and requested issuance of a second Federal Register notice. While it is clear that none of the items discussed by TNRC in its letter are well founded, you may nevertheless wish to respond. A draft response for this purpose is attached, as is TNRC's request of July 1,1980.
