S 22, and 10 C.F.R. SS 2.711 and 2.714 for permission to intervene in the above-captioned matter and, in support thereof, set forth the follow!.ng:

A. Backcround

1. On July 2, 1980, the Nuclear Regulatory Comission ("NRC" or "Cc=ission") ordered Metropolitan Edison Company (" Met-Ed"),

operator and part-owner of the Three Mile Island Nuclear Station, Unit 1 (_" TMI-1 " ) to maintain TMI-l in its then-existing shutdown condition until further order of the Cor=nission.

2. On August 9, 1980, the Commission established a hearing pro-cedure to decide certain issues relating to the restart of TMI-1.

(2) The nature and extent of the petitioner's property, financial, or other interest in the proceeding; (3) The possible effect of any order which may be entered in the proceeding on the petitioner's interest.

7. Petitioner's right to intervene is found in Section 189(a) of the Atomic Energy Act, 42 U.S.C. S 2239 (a) , which grants party status to any person "whose interest may be affected by the proceed-ing." As demonstrated below, cognizable interests of Petitioners may be affected by the outcome of the instant proceedings. Petitioners therefore seek to have an opportunity to participate in this decision-making process which will so directly impact upon their future.

8. As stated, Petitioners are among the largest industrial users of Met-Ed. Additionally, Petitioners would represent all Met-Ed customers whose property and financial interests have been and will be affected by the Commission's Shutdown Order and by the outcome of this proceeding.
9. As a result of uhe July 2, 1980 Shutdown Order and the August 9, 1980 Order and Notice of Hearing instituting this proceed-ing, Met-Ed has not been permitted to use its generating capacity at

! TMI-l and has been forced to purchase electricity at much greater cost than the power generated by TMI-1. This greater cost has been passed along to Met-Ed's customers, including Petitioners.

10. As a direct result of these higher electrical costs, which form a substantial *part of many of the Petitioners' operating costs, Petitioners have been placed in a greatly disadvantaged position to

===petitors serviced by other utilities--sometimes located only a few miles away. With substantial increases in electrical costs since March of 1979, Petitioners cannot continue to abscrb such excessive electrical purchase costs and remain ecmpetitive.

13 - In addition to the loss of co=petitive position, some of the Petitioners have indefinitely continued expansion plans or are considering cutbacks in production with concomitant furloughs of employees.

12. As a direct consequence of the Commission's Shutdown order and the instant hearing procedure to deter =ine Met-Ed's compliance with or ability to comply with the short- and long-ter= recuirements set forth in the August 9th Order and Notice of Hearing, Petitioners have suffered great property and financial loss. This loss is not from their status as rate payers per se, an interest admittedly not suf ficient to warrant intervention, rather the loss is directly occasioned by the Commission's Shutdown order. This direct financial or property loss has been recognized to be within the ":ene of interest" necessary for party status. See Virginia Electric & Power Co.

13. The final f a= tor specified in Section 2.714 (d) concerns the possible effect any order may have on Petitioners' interests.

Obviously, a ruling by the Ato=ic Safety and Licensing Scard and/or the NRC that Me:-Ed has nor =e: or is unable to =eet either the rhort- or long-ter= require =ents and that TMI-1 must re=ain shut down will only exacerbate Petitioners' already deleterious position.

On the contrary, an order per=itting Met-Ed to bring TMI-l back on line will greatly serve to lessen Petitioners' financial and property losse.s. To repeat, Petitioners' interest is not in their electrical rates but in the financial and property losses which have been =aused by the Co-~4ssion's Orders of July 2, and August 9, 1980' requiring the continued .Tutdown status of TMI-1.

Petitioners will take lhe position that Met-Ed is now able or will be able to de=onstrate compliance with the short-ter= require =ents established in the C===ission's August 9th Order and Notice of Hearing.

Further, Petitioners will contend that Me:-Ed has the capacity to

=eet the long-ter= requirements and to operate TMI-1 safely with due consideration for the health and safety of the people of the central Pennsylvania area.

Finally, Petitioners will de=enstrate that Met-Ed does possess the =anage=ent capanilities to operate TMI-l safely and in full accord with the Co--ission's rules and regulations.

C. Timeliness

14. Although this Petition to Intervene is being =ade afcer the final date established by the Co= mission for such petitions, the Co==ission's regulations specifically permit the granting of otherwise untimely intervention applications when certain criteria are met. 10 C.F.R. S S 2. 711, 2. 714 (a) . The instant Petition to Intervene clearly meets these standards.
15. Petitioners have reviewed the list of parties currently participating in this proceeding and the proposed contentions of such parties available in the public document room in the State Library of Pennsylvania. As a result of this review, Petitioners believe and therefore aver that Petitioners' interests will rat be represented by existing parties. The great majority of those partici-pating in the hearing process appear to advocate positicas ec.trary to recitioners' interests. While the positions of the governmental parties may prove not to be contrary to Petitioners', their partici-pation as Section 2.715 (c) parties obviously does not make them adequate substitutes for advocating Petitioners' interests. Finally, while Petitioner's position will not be entirely antagonistic to the utility's, it may not be totally parallel either. Indeed, there

=ay be instances where Petitioners may oppose the position adopted by the utility. In short, Petitioners' interests are not duplicated by those of the utility's and Petitioners' interests cannot be adequately represented by the utility.
