Dear Mr. Marshall:
This letter is in response to your phone conversations with NRC personnel concerning the recent change in Comission policy on procedural assistance in adjudicatory proceedings. published in the Federal Register on July 25, 1980. A copy of that Federal Register notice was sent to you under letter dated August 4, 1980.
It is not clear a us what, specifically, you are requesting.
Under the new Comission policy, you may request one copy of the transcript in a proceeding to which you are a party and it will be provided free of charge. The second area of procedural assistance which is affected by the new policy is the copying and circulation of testimony, proposed findings of fact, conclusions of law, and responses to discovery requests. This policy would provide that should you have any testimony, proposed findings of fact, conclusions of law or responses to discovery requests which you wish to present in a proceeding to which you are a party, the Comission will copy and serve those materials on the other parties to the proceeding.
Finally, the Comission regulations are amended under the new policy to require that each party need only file an original and two copies of a pleading or other document (other than correspondence) with the NRC, rather L
than an original and 20 copies. These are the only changes made under the new Conmission policy which went into effect on July 25, 1980.

The Staff has determined that the new policy, which is to be used for a l
one-year test period, is not retroactive to apply to transcripts of pro-l ceedings or party presentations prior to the July 25, 1980 effective date of the new policy. Therefore, requests for transcripts of proceedings which took place after July 25, 1980 would be appropriate.
If there has been a transcribed proceeding after July 25, 1980 to which you were a party, you may request a transcript of that proceeding. This office would ask that you make that request in writing and specifically i

identify the proceedinc (including the date on which it took place) of which you wish a transcript.
