MOTIO 1 T0 STRIKE SAGI:lAN'S EXCEPTIO'!S v',g J Under date of April 14, 1975 Consumers Power Co. (the " licensee") has coved this Board to strike the exceptions filed by Saginaw Intervenors to the Licensing Board's decision in this show.cause proceeding. The notion is grounded in Saginaw's failure to file a timely brief in' support of its-exceptions.

In vie./ of:

- Saginaw's stil_l-continuing failure-to file the brief required by 10 C.F.R. 2.762,

- repeated prior exaaples of Saginaw's casual regard for the adjudicatory process, and

- the uncontested evidentiary record, the Regulatory Staff must support the licensee's notion.

Respectfully submitted, Counsel for URC Staff )
