9PPOSITIC?! 0F-REGULATORY STAFF TO
'SAGI: LAW GROUP'S l:0TIO lS FOR CELAY By(apleading E filed in this proceeding and received by the Staff on; Friday, fia) 24, 1974, Saginaw Group has moved'the Board for a delay in answering" interrogatories propounded'to it, as well as a delay in submitting to the takingLof any depositions.
In addition, Saginaw Group asks' permission to file a pleading at a defined future-date which would reargue an issue already disposed'of by the Board.
The asserted-bas ~is ~ for these three requests. for delay is the absence of any final: disposition, as yet, of a petition which the Saginaw Groupfh'as filed with the Commission E' for costs and fees associated p
-with -its participation in this proceeding.
!The-Stafflopposes-granting the requested idelays.

. Although the Saginaw Group ' announced.'as early as March 23,1974 2 its intentios.toirequast costs and fees in connection with its participation in.this r,roceeding, it.was May 14, 1974 before any such requast was
- received by the Secretary.
Threfore, in ei fect, we have the Saginaw-Group ~asking for-further delrys--in this proceeding as a result of its own. month and half delay in pursuing an ancillary request with the
- Commission.
Moreover, the instant ~ motions were not filed when the Board established.
the schedule for-filing and responding to interrogatories on March 28, 1974'. 'They were not' filed when Saginaw Group filed its extensive inter-rogatories against the Staff and other parties.
They were'not filed-When objections-to. interrogatories'were due. They were not filed when-the Board ruled on-those. objections.
Rather, they were dated one day before answers were due, and received by the. Staff. two days after answers were due.
q Whatever.the merit of_the Saginaw Group's ancillary request now'pending
.before the Cormission, it cannot ' justify the flouting.of the Board's
