The case does not . deal with the question of whether the agency 4' has jurisdiction to conduct further proceedings while the ,
case is undergoing judicial scrutiny.. -

Given this posture and for the reasons set. forth below, we respectfully suggest that.the Commission is without juris-diction:to reopen the Vermont Yankee proceeding or any, other individual licensing p;eceeding on the so-called " fuel cycle" issue. ,

'in- the presence of the court's continued and exclu-
.sive jurisdiction '[is] without authority to deal with its -
