N I" This is in response to your letter to Jerry Nelson dated February 16, 1978, but which, as I recall, we received towant the end of the month.
Your letter concerned a memorandum by the Office of Inspector and Auditor (OIA) relating to matters that had arisen in the Midland licensing proceeding. Because of its possible ex parte nature, we served the memorandum on the parties to that proceeding after our office learned that a copy had been furnished earlier to Chainnan Hendrie. For the same reason, we also served your letter of February 16 on the parties to that proceeding.
For administrative convenience and to avoid compounding the ex parte problems, I am replying in separate, letters to the two requests you presented. I am responding here to your recommendation concerning what i
procedures, if any, should now be followed with regard to the OIA memorandum. I hope to respond in the near future to your more general 5
l co.ments about a possible rulemalting on the staff's role in the licensing process.
As you probably know, the matters to ',:hich the OIA memorandum relates
-are referred to in a concluding footnote of the Appeal Board's decision of February 14, 1978, in the Midland proceeding, ALAB 458. That footnote directs the Licensing Board to air fully and resolve issues related to "an alleged, albeit unsuccessfbl attempt by the applicant to prevent full' disclosure" - the subject matter of the OIA memorandum.
In your letter, you express the view that the applicant's conduct pro-vides probable cause for legal action and you suggest that the matter be referred at this time to the Department of Justice for its independent assessment. As-the OIA memorandum reflects, it constitutes only a preliminary. consideration of the Midland matter. Such a preliminary inquiry contemplates the possibility that the matter may.be reviewed later in the light of subsequent developments. While I have not made an independent review of the record, I have no present basis for disputing
