Dear Mr. Head:
I was informed an September 14, 1976 by officials ou the Nuclear Regulatory Commission that an order was entered in the Midland proceeding directing you and the other members of the Atomic Safety and Licensing Board to consider the totality of issues required to be considered by the Court of Appeals' decision in the Aeschliman case.
This, of course, includes whether con-struction of Midland should be halted pending consideration of the remanded rearings. As I understand the Commission's order (it was issued in response to my request and motion), the Licensing

Board is now required to consider suspension proceedings in light of the broader issues and not limited merely to the fuel cycle issues.
As the Board knows, our brief filed by messenger on September 10, 1976, was written on the assumption that the Commission would issue the order which it did on September 14, 1976.
Accord-ingly, we wish our brief filed on that date to stand and hereby re-quest that you direct the Nuclear Regulatory Commission Staff and Consumers Power Company to file immediate updated briefs on the totality of the suspension issues within the next ten days.
If there is any matter which you desire that we brief, please let me know.
