This ' refers to the letter to Chairman. Rosenthal,

dated March 26,?1973, from Myron M. Cherry, Esq.. counsel for thetSaginawiIntervenors in this proceeding. - In that

-letter, Mr. Cherry purports to supply _information-which Dr. Buck requested' of._ him in the course of oral ' argument before the Appeal Board-on March 14, 1973..

It-will be' recalled - that it.was made clear that what was

~

-being requested.of Mr. Cherry was " facts or documents".,

" transcript ; references. and documents

. and that is ' all, not' argumentation.

..;"_ and that the Board would not consider anything supplied by Mr. Cherry outside the record withoutlgiving other parties an opportunity "to address

' that material".

- Applicant'in this; proceeding is. appropriate.

Under. the heading " Question No. l", the March 26 letter discusses Dr." Buck's request relating to information

'which the Saginaw Intervenors claimed to have. acquired-

He also asked-Mr. ' Cherry whether-he has "a topical reference

?to that?"

(Ibid).

- Mr.1 Cherry state'd.that the information "comes from rgf activities - in-Bethesda ' at the ECCS Hearings. "

However, he. stated that he does "not have a document reference.

but that-he would "make some effort this week to try to docu-ment that'.

(Ibid)

He also indicated that "Mr. Ford

" have such a document in his; possession.

(AB Tr. 60) may.

- In his March 26 letter, Mr. Cherry admits that:

"We have searched our records and cannot find any documentation."

This - should end' the matter, particularly in light. of the Board's clear statement 'that it wished only "fects,""trans-cript references. and documents" and "not argumentation. "

Nevertheless, on the -basis of his own representa-tion' of ' the truth ~ of the statements he cannot document, Mr. Cherry now requests that 'this ; Appeal Board order Mr. Kartalia to "re-

-spond to this issue.

In effect, this is a-request for ' discovery and argu-mentation in support of'the' request.

The discovery is requested

.with respect to matters:which were within the knowledge of.the Saginaw Intervenors or their counsel-well before the termination of theLHearing below.

The contention and the request should therefore be ignor'ed.

The materials. referred to.in the March 26,.1973, letter under the headings " Question No. 2"' and " Question No. 3" osten-sibly:rulate-to record references.

During-the' oral argument

' Dr. Buck noted "that.a reference ' to p. 2624-25 of the hearing

~ transcriptncontained on p. 53-25.of the Saginaw Exceptions H

"is obviously an incorrect ~ reference..

" and requested "the j

correct one"=(AB.Tr.s 58).

Dr. Buck. also noted that a reference l

containedLon p;.53-24 of the Saginaw Exceptions was to "a-mix'd e

~ bag of? cross-examination". consisting of more than 300 pages.-

~He stated "I would 'like to know what -it is in those 300. odd pages? that you are' referring to." ' L (Ibid)

An examination of the references and editorial-comment d

-. contained under the headings :" Question No. 2" and " Question 4 'c JNo'.D3" in?the March' 26 -letter makes it clear' that f ar more than

" facts or, documents" or " references.and documents" have been

~

supplied.

Thus',- with respect to " Question No.

3" the March 26

-letter lists -12. " areas _ succinctly", labelled A through L.

Each makes a: contention of alleged " fact" or refers to an

- admission and cites allegedly-supporting-hearing transcript

- references.

However, the reference in the originally filed Saginaw Exceptions to :"a mixed bag of cross-examination" reported in over 300. pages of the transcript -was. a clear violation of the provision - of 10 CFR 2.762 (a) which requires that exceptions "shall-specify precisely the portions of.the record relied

' upon.

It was,- of course, Jmore than a technical viola--

tion', for the Saginaw Exceptions did not refer to the allegations of " fact" subsequently made 'in ' items A through L, and, therefore, a reply; to those allegations was impossible.

Had the allegations of. fact" now contained in the March 26 letter been included in

- the originally filed-Saginaw Exceptions, the Applicant's Brief

-in Opposition would have treated -them expressly and in detail.

- In this context we believe the items -labelled A' through L in

- the March 26 letter constitute either a supplement to Saginaw's '

original exceptions-or contentions in support of wholly new exceptions.. 'No good cause has been shown for filing such new or _ supplemental exceptions at this late date.

Accordingly, we

. assume they will not.be considered by this Board.

.Nevertheless,.the opportunity to supply " facts",

" documents" and " references" has-been seized _upon to make new,

- untimely,_' unjustified and unsupported contentions.

We therefore-

-believe we are at least entitled to point out that our failure to _ reply in detaili does not constitute an admission of the accuracy of any,of the " facts" alleged.

To the contrary, each

- of the listed-items"contains either argumentation, editon. liza-tionf or a statement -oficonclusion not supported by the cited transcript references"or which stretch the facts contained in

those references l(the material cited.under the heading
