IMPOSITION OF CIVIL PENALTIES - $3,000 By EN-80-29, dated July 3, 1980, the Commission was notified of the intent of IE to issue a Notice of Proposed Imposition of Civil Penalties in the amount of Three Thousand Dollars to Teledyne Isotopes, Incorporated.
The proposed penalties were based on two alleged items of noncompliance relating to the delivery of packages of low specific activity radioactive licensed material to a carrier for transport to a waste burial site and the packages were not packaged and labeled in compliance with the regulations.
The licensee responded to the Notice in a letter dated July 30, 1980.
After consideration of the licensee's response, the IE Staff concluded that the items of noncompliance did occur and no adequate reasons were given by the licensee for mitigation or remission of the proposed penalties.
Accordingly, an Order Imposing Civil Penalties in the amount of Three Thousand Dollars has been issued today.
The licensee and the State of New Jersey are being informed by telephone.
Since this matter was the subject of an NRC news release on July 8, 1980, no additional release is planned.

Under the terms of the Order, the licensee may, within twenty-five days of the date of the Order, pay the civil penalties or request a hearing.
