Dear Chairman Morse:
Your letter of June 30, 1980, to the Nuclear Regulatory Commission has been referred to me for reply.
As Director of the Office of Nuclear Reactor Regulation, Nuclear Regulatory Commission, I wisn to thank you for advising the Commission of the official action of the Board of Selectmen, Town of Salisbury, on May 13, 1980, in approving Article thirteen which requests "... the Selectmen to infonn the Nuclear Regulatory Conunission that no operating license should be granted i
to the Public Service Canpany of New Hampshire because there is no way to safely evacuate the surrounding area."
Operating licenses will not be issued for Seabrook Station, Units 1 and 2 until the applicant, Public Service Company of New liampshire, develops and implements an Emergency Plan in accordance with the Ccmmission's regulations.
In parallel with our review of the Emergency Plans of Public Service Company of New Hampshire, the Federal Emergency Management Administration (FEMA) will be reviewing emergency plans for areas near the Seabrook Station that are not under the direct control of the Public Service Company of New Hampshire. Results of reviews by both the FEMA and NRC will be considered by the Cocinission in determining whether operating licenses should be issued. We have advised the FEMA staff of your concerns.
Although both the FEMA and NRC staffs dre currently proceeding with reviews of emergency planning matters, the Final Safety Analysis and Environmental Reports have not yet be.en filed to start the operating license review. When these reports are filed and accepted, members of the public will be advised by a Federal Register Notice which will describe procedures b.v which any member of the pud!ic may petition for a hearing. Although your letter of June 30, 1980, was your means of fonnally infor.'ing us of the position of the Town of Salisbury we do not treat it as a petition for hearing.
If you wish to petit'on for hc? ring, you should do so after the above described Notice of receipt of application and opportunity for hearing is published in the Federal Register using procedures that will be defined l
in the Notice.

The Town of Salisbury had the following Article placed in the Warrant for the 1980 Annual Town Meeting held on May 13, 1950 on petition of Mr. Frank Kramer and others:
ARTICLE THIRTEE::
"To see if the Town will vote to request tne Selectmen to inform the Nuclear Regulatory Commission (URC) that no operating license should be granted to Public Service Company of New Hampshire because there is no way to sarcly evacua'.e the surrounding area.

Tne Town Meeting voted unanimously to approve this Article.
