Dear Ms. Cohn:

This letter is sent to acknowledg'e your letter dated June 5,1980, on behalf of the City of Gary, Indiana, United Steelworkers of America Local 6787, the Bailly - Alliance, Save the Dunes Council and the Critical Mass Energy Project in which these organizations request to join in the State of Illinois' request for action to suspend or revoke the construction permit. for the Bailly facility. Your request is based on your view that consideration should be given to whether the popula-tion in the vicinity of Bailly can be evacuated within a reasonable period of time in the event of a nuclear accident at this facility. The State of Illinois' original letter on this matter dated November 13, 1979, is being treated as a request for action under 10 CFR 2.206 of the Commission's regulations. We have recently suggested to Illinois (Enclosure) that we delay for a number of months, our response to its petition pending the outcome of a risk assessment study we may request Northern Indiana Public Service Company (NIPSCO) to perform. We will contact you regarding a meeting with my staff on ~this matter as you request following the formal issuance of the Federal Emergency Management Agency's report on the evacuation feasibility study within a ten-mile radius of the Bailly facility. Dear Sirs:

The City of Gary, Indiana, United Steelworkers of America Local 6787, the Bailly Alliance, Save the Dunes Council and the Critical Mass Energy Project have today joined in the State of Illinois' request for action to suspend or revoke the construction permit for the Bailly Nuclear Power Plant. The request is based upon the necessity for a consideration of whether the populations surrounding Bailly can be evacuated within a reasonable period of' time in the event of a nuclear accident. The City of Gary, et al. hereby join in Illinois' request for a meeting with the Director of the Office of Nuclear Reactor Regulation to discuss this request for action. We also believe that it would be appropriate for the meeting to be held shortly after issuance of the Federal Emergency Management Agency's report on emergency planning within a ten mile radius of the Bailly site.
