MEMORANDUM AND ORDER October 28, 1980 By letter of October 27, 1980, the NRC staff responded to this Board's inquiry concerning the delegated authority of L.S. Rubenstein to issue the notice of opportunity for hearing on the application for a construction permit extension (which notice triggered this proceeding). S For the reasons stated
'in its letter, the staff asserts that Mr. Rubenstein had the requisite delegated authority.
Although the matter was raised by this Board sua sponte, it seems appropriate to permit the parties to the pending ap-peal to con: ment, if they so desire, upon the staff's response.
