SUMMARY

OF LAWS ENACTED BY STATES DURING 1978 The following is a sumary of laws relating to the nuclear regulatcry program which were enacted by the States during the 1978 legislative ;ession.

TRANSPORTATION COLORADO HJR-1045.

Directs the Legislative Council to study the trans-portation of radioactive materials within the State by air, motor vehicle, or railroad to " determine and provide recomendations to protect against the hazards of such transportation." The report is due during the next legislative session.

ILLIN0IS H-3350.

The Illinois Comerce Comission is charged with promulgating rules and regulations governing the transport of hazardous material in the State.

LOUISIANA H-420.

Bans the transport of high-level radioactive waste, including spent fuel, into the State for disposal or storage in the State or elsewhere.

MAINE H-1958.

Sets the following conditions before hazardous material can be transported within the State: vehicle must be marked with placard; and the operator must have a bill of lading stating the name of the material and its location within the truck.

VERMONT H-549.

The Department of Transportation is authorized to promulgate rules and regulations governing the transportation of hazardous materials, including radioactivity.

A Hazardous Materials Comittee is established to develop an emergency plan in case of an accident to supplement, aid or advise local and State jurisdictions.

SITING CALIFORNIA A-2923. Allows utilities to include in the rate base reasonable and direct costs they incur complying with the California Energy Commission's Notice of Intent (NOI) process.

Amends the current State code to 1) delete the limitation on the maximum allowable generating capacity (250nw) that could be approved l

by the Energy Commission in an energy supply emergency; 2) require the Energy I

Commission to authorize the construction and use of generating facilities in an emergency; and 3) provide for a shortening of the power plant siting process.
