i June 29, 1989 Note to File re claims that NRC Inspection of Meredith Corp. on this date had been cancelled.
On June 28, 1989, Roger Adelman, Counsel for Meredith Corp., was informed that the NRC intended to inspect the facilities of Meredith Corp. as of 12 pm or-later on June 29, 1989.
.Following receipt of that letter by Tip Letshe, also Counsel for Meredith Corp., several telephone calls among Mr. Adelman and/or Ms. Letshe and 0GC attorneys took place.
Two telephone calls took place the evening of June 28, 1989.
During those calls, Ms. Letshe and Mr. Adelman were advised that the inspection planned for the next day would likely go forward but the NRC would contact them again the following morning.
1 inquired as to whether or not Meredith Corp. could
. provide the NRC with a verbal refusal to enter to obviate the need to send inspectors to the facility in a futile effort.
The attorneys responded that
-they could probably do that.
On.the morning of. June 29, 1989, Jim Fitzgerald, Leo Slaggie and'I spoke with Ms. Letshe.
She was informed that the NRC intended to inspect the Meredith facilities at noon or later and that the NRC inspectors were en route. She informed us that her client would most likely not aomit the inspectors. Given this representation of likely refusal of access, I advised her that the NRC had the opportunity to contact the inspectors en route and could bring them back to Headquarters.
At no time during this or any other conversation with either Ms. Letshe or Mr. Adelman did I or any other 0GC attorney represent that the NRC would not attempt to conduct the inspection or that the inspection was cancelled. Following this conversation and in consultation with the Vendor Inspection Branch, it was determineo not to call the inspectors back-but to proceed to attempt to gain access to the lieredith facility.
At about 4 pm on June 29, 1989, a final telephone conversation was has with Ms. Letshe, Vendor Inspection Branch and OGC staff, and the Meredith site. At the Meredith site were Meredith officials and the NRC inspection team. During this conversation, Ms. Letshe made clear that there would be no NRC inspection of the Meredith facility on this date. The NRC inspectors were instructed to
' return to Headquarters.
