MEMORANDUM AND ORDER (Memo from Staff: Rockwell Quality Assurance Obligations)
This morning I received a memorandum 1 from the Staff of the Nuclear Regulatory Commission (Staff) questioning the applicability of Appendix B to SNM-21.
Regrettably,'the Staff memorandum has not resolved matters in my mind.
Rather it has led to the following two questions:
1.
10 CFR S 70.4(r) appears to classify Rockwell's previous activities under its license as those of a
" plutonium processing and fuel fabrication plant" because it was involved in "(iv) recovery of scrap material" (i.e., fuel decladding) And in "research and development activities involving.
recovery of scrap material.
Why then was it not covered by Appendix B?
2.
If, indeed, Rockwell was not covered by Appendix B, then what are the applicable Staff
