Amendment of Construction Permit CPRR-123

Dear Sir:

Pursuant to section 50.55(b) an extension was requested for The University of Texas construction permit (CPRR-123).

Extension-of the final completion date by 4 months to April 30, 1990 was requested.

Please amend the request (letter November 7, 1989) for an extension period of 12 months to December 31, 1990.

Reasons for this amended request are to assure that all license processes are likely to be completed without the necessity of any additional extension request, as per suggestion by telephone conversation with NRC staff.

Basis for the extension are as follows:

A previous extension of the CPRR-123 to December 31, 1989 was necessary to complete the transfer of project construction to an alternate contractor.

The original contractor default and subsequent change of contractors from CIT, Inc., of Texas to R. L.

Pender and Associates was the responsibility of the surety-company, Fireman's Insurance Company of Newark, New Jersey.

This delay in the completion of the project also set the schedule for the reactor vendor, General Atomics activities.

Subsequent completion of virtually all work of both contractors was done by August 31, 1989.

However, several deficiencies and the necessity l

for some corrective work is either still in progress, in evaluation by facility staff, or not yet acceptable.

As a function of the facility check-out and test program, some of the corrective work and deficiencies will not allow for 100%

completion of all systems, including test and inspection within the current CPRR expiration date. The number of incomplete items should be less than five by December 15, 1989.

The basis for this extension request is the extended time necessary for the assignment of a contractor for project completion and the subsequent rework of items, some of which were the responsibility of the original contractor.
