.Under License DPR-1 General Electric possesses, but does not l
L operate, the deactivated Vallecitos Boiling Water Reactor (VBWR) facility.
GE now proposes that two modifications be made to that license (1) to eliminate the timing requirement on the i
submittal of the annual report; and (2) to complete the transfer

of subsidiary facilities from License DPR-1 to another broad

Roguested Amendments L
General Electric requests that the following amendments be made to License DPR-1 A.
That License Condition 3a. be revised to read:
" Pursuant to Section 104b of the Act and Title 10, CFR, Chapter 1, Part 50, ' Licensing of Production-and Utilization Facilities', to possess, but not to operate the facility.
The facility shall consist of the reactor building and its contents."
B.
That License Condition 5d.(2) be revised to readt l
"An annual report of the status of the deactivated facility, including the results of the surveys of l
radioactivity levels."

Bases A.
License Condition 3a.
l Amendment No. 18 (9/9/65) permitted General Electric to possess, but not operate, the VBWR facility.
An Order Authorizing Dismantling of Facility (7/25/66) permitted the transfer of a number of facilities exterior to the reactor building (the containment l
building when the reactor was operating) to the ESADA-Vallecitos Experimental Superheat Reactor L
(EVESR) facility (License DR-10, Docket 50-183).
These facilities were in turn removed from License DR-10 by Amendment No. 2 (4/15/70) to that License and are now possessed under State of California byproduct material license 0017-60.
In addition to the reactor building and its contents, a number of facilities. including the ventilation system, the stack, the main valve pit, and outside piping remained under License DPR-1.
The requested L
modification of License condition 3a. will restrict L
License DPR-1 to the VBWR reactor building and its contente.
The other facilities will be held under the California broad site byproduct material License 0017-60.
The modification will make License DPR-1 consistent i
with License DR-10 and clarifies the boundaries of License DPR-1.

License condition 5d.f2)
License Condition 5d.(2) of Amendment No. 18 to License.DPR-1 requires that the annual report for the VBWR facility be submitted within 60 days of the annual-inspection.
This limits the scheduling of the annual inspection.
An earlier inspection, e.g.,
mid-September, would require the annual report for 4
that year to be submitted before the end of the calendar year.
The requested modification would L
simply require an annual report and would assure that l
each report covered a calendar year.
The timing on the submittal of the report vs. the annual inspection date is not crucial as past reports have shown that conditions at the VBWR are not subject to abrupt changss.
This change will also make the reporting requirements of License DPR-1 consistent with site reactor licenses R-33 (Docket 50-73) and TR-1 (Docket 50-70).
