I l P i f U.S. Nuclear Regulatory Comission Coments on the Office of the Inspector General Semi-Annual Report for the Period April 15, 1989 - September 30, 1989 c The Inspector General Act of 1978, as amended, requires the head of the agency to transmit the semi-annual reports on the agency's Inspector General (IG) to the appropriate committees and subcomittees of Congress within 30 days after ' receipt of the report. together with a report by the head of the agency con-F taining any coments such agency head detemines appropriate. OIG's semi-annual report for the period April - September 1989 identified two audit recomenda-tions for which no management decision was made by the end of the reporting period. On March 12, 1985, former Office of Inspector and Auditor (OIA) forwarded to the Comission an audit report entitled "Use of Consultants at Waterford," which examined NRC's contracting for consultants to assist the inspection team at the Waterford Nuclear Power Plant. In the report, DIA recomended that the Director, Office of Investigations, in coordination with the Executive Director for Operations, prepare a paper asking the Comission's opinion on whetRr to pursue a policy of paying iridividuals for information as part of an investi-r gation._ For a variety of reasons, action on this recomendation was deferrtd. Because the issue involved is important to the OIG as well as to the stafi, resolution of this issue should be coordinated with the recently confirmec NRC Inspector General. The Office of General Counsel and the NRC staff will prepare a plan and timetable for resolving this recommendation, coordinate their proposal with OIG, and submit it to the Comission for resolution. An audit report entitled " Review of NRC's Systematic Assessment of Licensee l Performance (SALP) Program" (0!G-87A-21) was issued to the Commission on l August 15, 1989. The purpose of the audit was to determine if the SALP program was being carried out as designed and if it was providing the benefits intended. O!G made several recommendations to agency management. However, the NRC staff disagreed with the second recommendation, which was elevated to the Comission for resolution on August 25, 1989. This recommendation related to the need for a consistent policy regarding SALP reviews for nuclear power plants that are shut down because of safety problems and the need for an un-acceptable SALP rating for these plants. In accordance with the Comission's direction issued on October 5,1989, the Office of Nuclear Reactor Regulation is currently developing a paper addressing the issues involved and a proposed policy on this matter. Once this report is received, the Comission will decide what additional action may be necessary on this matter. l 1 l l \\ l n .~
