Dear Licensing Board Members:
This refers to' the November 21, 1989 Licensee letter to the Board signed by Mr. Harold F. Reis, Co-Counsel for Florida Power and Light-Company (FPL). As stated, in part, in the Licensee's November 21, 1989 letter: "...makes further allegations and innuendoes-of wrongdoing, . illegality and -violations which are also unjustified and which FPL also-rejects. It'is becoming increasingly obvious thet Mr. Saporito' is trying. to convert this proceeding into a sounding . board for his complaints against a former employer which should be addressed by other authorities. We trust that the Board will' not permit itself to be so used." Petitioners address here that the Licensee merely makes a statement of rejection to the aforementioned allegations, a repeat of their earlier response to such allegations. The Licensee proffers no probative evidence to the contra y and Petitioners have addressed
- many, if not
- all, of these allegations to the proper government authorities for investigation and resolution.
Petitioners fully intend to provide the Board with testimony and exhibits evidencing the aforementioned allegations during the public hearing. Petitioners adamantly reject the Licensee's assertion that "Mr. Saporito is trying to convert this proceeding into a sounding board -for-his complaints against a former employer..." Although the Licensee is the former employer of Mr. Saporito, and may very well be the future employer of Mr. Saporito, pending the U.S. Secretary of Labor's decision germane to 89-ERA-7 and 89-ERA-17, we address here that Mr. Saporito is the Executive Director of the Nuclear Energy Accountability Project (NEAP). Therefore, it is Mr. Saporito's lifelong commitment to ensure public safety and the protection of the environment relevant to nuclear energy issues, and that commitment has_ no bearing specifically on FPL. - w Finally, Peti $1oners address here that the Licensee's assertion that Petitioners are using this Board is simply absurd. Indeed, this-Board is
- mandated, in. part, to ensure that the granting of the j
pressure / temperature limits license amendments, does not pose undue risk :to-public safety and the enviornment and that the Licensee-operate its ' nuclear-facilities in full compliance with NRC requirements =and regulations, i Therefore, it is well within the authority and jurisdiction of this Board to consider - any evidence that. the Licensee may not conduct operations of its nuclear facilities-in full compliance with NRC r'wqui rements and federal regulations. The introduction of testimony and evidence into this proceeding germane to the unsafe operation of-the Turkey Point nuclear facilities is the intent off i Mr. Saporito and-this intent does not represent a using of the ' Board. Consequently, Licensee's arguments to the contrary as 1 submitted by Mr. Harold F. Reis, should be categorically rejected -l and not considered by this Board. We are confident in the wisdom of this Board to see past the l Licensee's. maze of legal alchemy in the interest of public safety l and the environment as a whole.
