INTERVENORS MOTION FOR EXTENSION OF TIME IN WHICH TO FILE AN APPLICATION FOR STAY OF LBP-89-32

'The Massachusetts Attorney General, the New England  !

Coalition.on Nuclear Pollution.and the Seacoast Anti-Pollution League.(the "Intervenors") move this Board for an order j permitting.them to file an= application for a stay of LBP-89-32 '

later than 10 days after service of that decision as' set forth ,

1 in 10'CFR S 2.788(a).

In support of this motion, Intervenors state: '

L 1. On November 13, 1989, the Licensing Board in LBP-89-32 issued its' initial decision and authorized license issuance.

On that same day, Intervenors moved this Board to revoke that I

authorization on various grounds.

2. On November 15, 1989 this Board issued an Order in response to that motion holding it in abeyance pending the 8912050145 391115 r

Licensing Board's " explanation" of its license authorization. t Further, this Board noted that the " Commission's effectiveness review should be scheduled for January 1990." Order at 2, 3.' Because the grounds for any stay sought by Intervenors at this time would-challenge the legality of the Licensing Board's November 13 authorization, and the lower Board's

" explanation" for.its actions may not be available in the 10 day period presently allowed, Intervenors seek to extend the time in which they may file a stay request.

4. Moreover, in the event'Intervenors' motion were granted, no stay petitions would be filed. Further, to the extent this Board believes the immediate effectiveness stay ,

pursuant to-10 CFR 2.764 will remain in place until January

-1990,; no purpose is served by requiring that Intervenors file stay petitions by November 24, 1989.

For the reasons set forth above, Intervenors request that they be permitted to file stay petitions with.this-Board within 10 days'after this Board's ruling on'Intervenors' November 13 Motion to Revoke the Seabrook license authorization. 1 1
