s ORDER The Massachusetts Attorney General, Seacoast Anti-Pollution League, and the New England Coalition on Nuclear Pollution ("intervenors') have filed a motion for an extension of time in which to file a stay of the Licensing Board's decision in LBP-89-28, 30 NRC That decision rejected the intervenors' late-filed low-power testing contentions and, pursuant to our unpublished order of November 14, 1989, became a final appealable decision on g

November 13, 1989, with the Licensing Board's issuance of its final partial initial decision, LBP-89-32, 30 NPC In its motion (at note 1) the intervenors state that l

even though the commission has directed that it will hear l

all stay requests of the Licensing Board's authorization of full-power operation or Seabrook, the Commicsion order concerns only applications for a stay of LBP-89-32.

According to the intervenors, we still have jurisdiction over their future stay request of LBP-89-28.

Putting to one side the question whether LBP-89-28 (an order merely denying the admission of late-filed contentions that mandates no action by any party) is susceptible to being enjoined, the apparent purpose of the intervenors' future motion is effectively to stay the Licensing Board's full-power license authorization for Seabrook.

Such an indirect action is clearly within the spirit, if not the letter, of the Commission's November 16, 1989, order and, therefore, any such stay application should be filed with the Commission.

Accordingly, the intervenors' motion for an extension of time to file such a stay application should also be filed with the Commission.

Hence, we are referring the instant motion to the Commission.
