Contract No 33-87-230' Modification No. 5 Page 2 of 8 The purpose of this modification is to (1) extend the contract period of performance by one additional year, for the period October 1,1989 through September 30, 1990; (2) incorporate Section B.2 for FY 90 services; (3) increase contract ceiling and obligated amount; (4) incorporate'SectionH.3

NOTE:

The obligated amount of $88,710.00 reflected under Modification No.

4-is incorrect. The correct amount should read $102,949.00. This modification increases the-obligated amount of $102,949.00 by $30,645.60.

Under Section F - Duration of Contract Period is revised to read as l

follows:

"F.1 Duration of Contract Period This contract shall commence on October 1, 1986 and end on September 30, 1990 with one twelve month option period."

The following clause is hereby incorporated as Section H.3 of the contract.

"H.3 Option to Extend the period of performance This contract may be extended for one additional twelve month period at the option of the Government by the Contracting Officer.

The Contracting Officer may decide to exercise this option at

- any time during the performance of this contract; provided, that the

' Government shall give the Contractor a preliminary written notice of its intent to extend at least 60 days before the contract expires.

The option will be exercised in accordance with contract clause 52.217-9, Option to Extend the Term of the Contract-Services.

(a)- The Government may extend the term of this contract by

The preliminary notice does not commit the Government to an extension.

DRUG-FREE WORKPLACE (FAR 52.223-6) i (a) Definitions.~As used in this clause,

'" Controlled substance" means a controlled substance in c

schedules I through V of section 202 of the Controlled Substances Act (21 U.S.C. 812) and as further defined in regulation at 21 CFR 1308.11-1308.15.

" Conviction" means a finding of guilt (including a plea of nolo contendere) or imposition _of-sentence, or both, by any judicial body charged with the responsibility to determine violations of the_ Federal or State criminal drug statutes.

" Criminal: drug statute" means a Federal or non-Federal criminal statute involving the manufacture, distribution, dispensing, I.

possession or use of-any controlled substance.

" Drug-free workplace" means a site for the performance of work

-done in connection with a= specific contract at which employees of the contractor are prohibited. from engaging in the unlawful manufacture, distribution, dispensing, possession, or use of a controlled substance.

" Employee" means an employee of a contractor directly engaged in the performance of work under a Government contract.

" Individual" means an offeror / contractor that has no more than one employee. including the of feror/ contractor.

(b) The Contractor, if.other than an individual, shall --

t (1) Publish a statement notifying its employees that the unlawful manufacture, distribution, dispensing, possession, or use of.a controlled substance is prohibited in the contractor's workplace and specifying the actions that will be taken against employees for violations of such prohibition; (2)-Establish a drug-free awareness program to inform such employees about---

(1) The dangers of drug abuse in the workplace; (11) The contractor's policy of maintaining a drug-free workplace;

_-(iii) Any available drug counseling, rehabilitation, and employee assistance programs; and (iv) The penalties that may be imposed upon employees for drug abuse violations occurring in the workplace.

(ii) Notify the employer of any criminal drug statute conviction for a violation occurring in the workplace no later than five'(5) days after such conviction.

_(5) Notify the contracting of ficer within ten (10) days af ter

cceiving notice _under subdivision (a)(4)(ii) of this clause,.from an emp10 vee or otherwise receiving actual notice of such conviction;-

. (6) Within 30 days after receiving notice under subparagraph (a)(4) of this clause _of a conviction, impose the following sanctions or remedial measures on any employee who is convicted of drug abuse violations occurring in the workplace:

(i) Taking appropriate personnel action against such employee, up to and including termination; or (ii) Require such employee to satisfactorily participate in a drug abuse assistance or rehabilitation program approved for such purposes by a Federal, State, or local health, law enforcement, or other appropriate agency.

(7) Make a good faith effort to maintain a drug-free workplace through implementation of subparagraphs (b)(1) through (b)(6) of this cla'use.

(c) The Contract'or, if an individual, agrees by award of the contract or acceptance of a purchase order, not to engage in the unlawful manufacture, distribution, dispensing, possession, or use of a controlled substance in the performance of this contract.

(d) In addition to other remedies available to the Government, the Contractor's failure to comply with the requirements of paragraphs (b) and (c) of this clause may, oursuant to FAR 23.506, render the contractor subject-to suspension of contract payments, termination of the contract for default, and suspension or det arment.
