.The Advisory Committee on Reactor Safeguards (ACRS), established by statute in i

1957,_provides advice to the Commission on potential hazards of proposed or existing reactor facilities and the adequacy of proposed safety standards. The i

Atomic Energy Act of 1954 also requires that the ACRS advise the Commission with l

respect to the safety of operating reactors and perform such other duties as the Commission may request.

Consistent with the Energy Reorganization Act of 1974, the Committee will review any matter related to the safety of nuclear facilities specifically requested by the Department of Energy (D0E).

Also, in accordance with Public Law 95-209, the ACRS is required to prepare an annual report to the 4

U.S. Congress on the NRC Safety Research Program.

iThe ACRS reviews requests for preapplication site and standard plant approvals, each application for a construction permit or an operating license for power

. reactors, applications for licenses to construct or operate test reactors, and

, substantive amendments to such licenses.

Consistent with the statutory charter of the Committee, ACRS reports, except for-classified reports, are made part of the public record.- Activities of the

' Committee are conducted in accordance with the Federal Advisory Committee Act which provides for public attendance at and participation.in Committee meetings.

The ACRS membership,' which is drawn from scientific and engineering disciplines, includes individuals experienced in reactor operations, nuclear reactor systems, electrical engineering, chemical engineering, civil engineering, materials engineering, mechanical engineering, nuclear engineering, reactor design, heat transfer and fluid flow, thermodynamics, reactor physics, and probabilistic j

analysis.

Proposed Generic Letter Regarding Service Water System Problems Affecting Safety-Related Equipment Proposed Resolution of Unresolved Safety Issue A-40, " Seismic Design Criteria" Proposed Resolution of Generic Issue 79, Unanalyzed Reactor Vessel (PWR) Thermal Stress During Natural Convection Cooldown Proposed _ Resolution of Generic Issue A-29, " Nuclear Power Plant Design for Reduction of Vulnerability to Industrial Sabotage-In performing the reviews and preparing the reports cited above, the ACRS held 12 full. Committee meetings and 58 subcommittee meetings and met with the Commission occasions to provide direct advice and discussion of the issues in the reports noted above.

The Nuclear Regulatory Commission, on the basis of the technical review functions outlined.in the statutory mission of the Committee, appoints ACRS o.,

members from the scientific and engineering disciplines with three prerequisites in mind:

outstanding scientific and technical ability, balanced and mature judgment, and willingness to devote the time required to the demanding work involved. The pool of persons so qualified is limited.

At the end of September 1989, the Committee included six members from academic institutions with nuclear and nonnuclear backgrounds and'four members who have retired from active

. employment with nuclear backgrounds.

There has been a conscious effort to obtain members trained in both nuclear and the nonnuclear disciplines who have had. considerable experience in various fields needed to evaluate proposed design, construction, and operation of nuclear power plants and related facil-ities.

This permits and fosters a concentration within the Committee of scien-tific and engineering proficiency, together with a diversity of viewpoints and perspectives, which provides assurance that adequate, independent open dis-cussion and analysis of the potential hazards of nuclear reactors and the adequccy of safety standards can take place.

lNRC-Advisory Committee on Reactor Safeguards During FY 1989, the membership included those experienced in reactor operations, nuclear reactor systems, electrical engineering, chemical engineering, civil engineering, materials engineering, mechanical engineering, nuclear engineering, reactor design, heat transfer and fluid flow, thermodynamics, reactor physics, and probabilistic analysis.

To provide for public involvement in the nominating process for ACRS members, the NRC issues public announcements soliciting nominees to maintain a list of-candidates for appointment of members when vacancies arise.

In the past, nominations have been received from the public, including organizations such as public interest groups and technical societies, and we expect this interest to continue when future vacancies are announced.

Further, the diversity of view-points presently represented by current ACRS members is broadly based from the standpoint of special fields of interest, employment experience, ar.f scientific or technical specialty.

These membership characteristics provide the committee with a balance of highly qualified technical experts in the nuclear and non-nuclear fields necessary to carry out the Committee's statutory requirements.

The ACRS and its subcommittees held 70 meetings during FY 1989.

The number of meetings-held is directly related to the number of reactor projects referred by-the Nuclear Regulatory Commission to the Committee for review; the number of generic issues which arose during the year; the number of criteria and guides

-referred to the Committee for review and comment; the number of DOE and D0D reactor projects referred; the number of special reviews requested by the NRC and Congress; and areas of particular interest / concern to the Committee. The full Committee normally meets once a-month for a three-day session to consider projects, generic and special reviews, and criteria and regulatory guides that

'are ready for full Committee consideration. ACRS subcommittees meet as neces-

.sary with licensees, NRC staff, and others to develop information for the Committee on the particular matters under review and to identify-those matters warranting particular attention by the full Committee.

If the Committee is to continue to meet the requirements of the statute which established it, and the later additions and amendments, it will need to continue to meet at a similar frequency in the future.

As established by the Atomic Energy Act of 1954, the Advisory Committee on Reactor Safeguards is a group of part-time experts mandated to perform certain t.

specific functions and provide advice to the Nuclear Regulatory Commission with

However, there is no other advisory committee, either within the Commission or in other agencies, with the current, broadly based knowledge of the.ACRS which could be called upon to provide advice to NRC for independent assessments of reactor safety issues, in' addition, since ACRS members are primarily part-time advisors with other full-time interests and activities in related fields, they generate an organized synergistic approach to provide a breadth of experience and state-of-the-art' technical knowledge which'would be difficult to duplicate with full-time govern-ment employees.

A continuing committee such as the ACRS also. remains current with respect to nuclear safety. issues,-including related reactor operating experience and safety-research, and provides a collegial judgment regarding these issues that would be impossible.to duplicate by use of individual, part-time consultants on a case-l by-case basis.

Through the ACRS, the public and the Congress are provided assurance that an independent technical review and evaluation of nuclear reactor projects and safety issues is accomplished and an opportunity for public input during ACRS'

HOW COMMITTEE ACCOMPLISHES ITS PURPOSES' The NRC staff believes that both licensees and the public in general benefit when recognized experts provide advice to the staff on certain medical issues in which NRC's standards may be unclear or inapplicab_le and when these experts can provide advice on rulemaking and other initiatives at critical stages t throughout their development. In response to the Commission's directions to NRC staff to develop a rule on quality assurance.(QA) in radiation therapy and other issues pertaining to the medical use of byproduct material, in November 1988, members of the ACMUI met.in public session and received comments from the medical community on ways to improve QA procedures. A report and analysis of statements.made at the meeting was submitted to the NRC staff for their use in developing the Commission's proposed rule. 208 cont. BALANCE OF MEMBERSHIP The Committee's membership started the year with 5 physicians, a medical physicist, and an NRC staff member who chairs the Committee. Two physicians, a medical physicist, and a medical technologist were added to the Committee during the year. The members, well-recognized specialists in their own-fields,. ~ are from different parts of the United States, represent such private office-and hospital-based practices, represent teaching and non-teaching hospitals, l and include two women and one minority member. The physician-members' i-specialties include diagnostic and therapeutic radiology, internal medicine, L cardiology, nuclear medicine and pathology. The scientist-members have broad . backgrounds in radiation safety, in medical physics associated with both l L diagnostic and therapeutic uses of radiation and radioactive materials, and radiopharmacy. The technologist member has experience in both nuclear medicine and hospital administration. 20C cont. 120A.. The Advisory ' Committee on-Nuclear Waste ( ACNW) was established by the U.S. Nuclear Regulatory Commission in June 1988. The ACNW'is tasked in its charter- ' to, '" report to and advise the Nuclear. Regulatory Commission (NRC) on all. aspects.

of nuclear waste management,-as appropriate, within the purview of NRC's regu-latory responsibilities.

The primary ' emphasis will be on disposal of high-level . nuclear waste but will also include other aspects such as handling, processing, ' transportation, storage, and. safeguarding.of nuclear wastes includino spent-Lfuel, nuclear wastes mixed with other hazardous substances, and ural. um mill tailings. In performing its work, the Committee will examine and r'eport on specific; areas, of concern ~ referred to it by the Commission or designated' rep-resentatives of the: Commission, and it is authorized to undertake other studies and activities.on ;its own initiative, as appropriate to carry out its respon-sibilities." y IACNW reports (except for any which may contain classified material) are made .part of the.public record. Activities of the Committee.are conducted in accor-dance.with the Federal Advisory Committee Act which provides for public atten-dance at.and participation in Committee meetings. The ACNW membership, which is ' drawn from scientific and engineering disciplines, includes individuals experi-enced-in geosciences, radiation protection, radioactive waste treatment,. -environmental engineering, nuclear engineering, and chemistry.

Facilities i In performing the reviews and preparing the reports cited above, the ACNW h' eld 9 -full Committee meetings and I working group session. The ACNW also met with the 'i l Commission on 2 occasions to provide direct advice and discussion of the issues in 1 2 0 B.' -the report #noted above. 1 The. Nuclear-Regulatory Commission,. on the basis of the ' technical review functions outlined in the Committee's charter, appoints ACNW members from scientific and engineering disciplines with three prerequisites in mind: outstanding scientific and technical ability, balanced and mature judgment, and willingness to devote the time required to the demanding work involved. The pool of persons so qualified is limited. At the end of September 1989, the 1 Committee included three. members from academic institutions, and one member who is an employee of a national laboratory. There has been a conscious effort to 'obtain: members with backgrounds that can address the difficult and diverse questions associated with radioactive waste disposal. This permits and fosters -a concentration of scientific proficiency within the Committee, together with a diversity of viewpoints and perspectives, which provides assurance that ade-quate, independent open discussion and analysis of the potential hazards of 1 nuclear waste can take place. ] During FY 1989, the membership has included engineers and scientists experienced in radioactive waste management, health physics, chemistry, nuclear engineering, environmental engineering, geology, geophysics, and seismotectonics. 4

O [ Advisory Committee on Nuclear Waste Of the current incumbents on the ACNW, two were drawn from the Advisory Commit-tee on Reactor Safeguards (ACRS); one, a former NRC office director, was select-s ed directly by the Commission; and a fourth was proposed for nomination by a i i technical society. It is expected that future appointees will be nominated in a manner.that will provide for increased public involvement in the nominating process; that is, the NRC will issue public announcements soliciting nominees to maintain a panel for appointment of members as vacancies occur. This will provide an opportunity for nominations.to be received from the public, including organizations such as public interest groups and technical societies. The diversity of viewpoints presently represented by current ACNW members is broadly based from the standpoint of special fields of interest, employment experience, and scientific or technical specialty, These membership charac-teristics provide the Committee with a balance of highly qualified technical-experts in the fields necessary _to carry out the Committee's mandate. 20C. The ACNW and its working groups held 10 meetings during FY 1989. The number of meetings held is directly related to the review schedule and scope of efforts on the high-level waste geologic repository, the number of criteria, guides, and technical positions referred for review and comment, the number of special reviews requested by the NRC, and topics of particular concern / interest to the Committee. The full Committee plans to continue meeting on approximately 8 out ~ of the 12 months during CY 1990. Full Committee meetings generally run two to three days and cover a variety of topics (review of the site characterization plan and related NRC staff analysis, technical positions on high-level and low-level waste issues, briefings and reviews of rulemakings, etc.). For particularly complex issues, the ACNW holds working group meetings where addi-tional time and expertise can be brought to bear on an issue and the subject g developed prior to full Committee consideration. If the Committee is to con-tinue to meet the requirements of its charter, it will need to continue to meet at least on a similar frequency in the future. 200. l The Advisory Committee on Nuclear Waste is an independent organization which is mandated to perform certain specific functions and provide advice to the Nuclear Regulatory Commission with regard to the potential hazards of all aspects of nuclear waste management within the purview of the NRC. The Committee is unique i-in that there exists no comparable body composed of acknowledged experts in the field of nuclear waste management whose mandate is to provide the Commission -with independent advice in this area. The Commission necessarily has its own expert staff on whom it relies in the day-to-day regulation of nuclear waste. However, there is no other advisory committee, within the Commission, with the current, broadly based knowledge of the ACNW which could be called upon for independent assessment of safety issues related to high-and low-level waste management and disposal. In addition, since ACNW members are part-time advisors with other full-time interests and activities in related fields, they generate an organized synergistic approach to provide a breadth of experience and state-of-the-art technical knowledge which would be difficult to duplicate with full-time government employees.

A continuing. committee such as the ACNW also remains current with respect to nuclear waste issues,-including related safety research, and provides a collegial judgment regarding these issues that would be impossible.to duplicate-by use of~ individual, part-time consultants on a esse-by-case basis. Through-the'ACHW, the public is provided assurance that an independent technical-review and evaluation of nuclear waste safety issues is accomplished and an opportunity for-public input during ACNW meetings is assured.- 1

-During this period, the Committee held 10 meetings comprising a total of approx-imately 152 hours.. Portions of 4 meetings were closed. Time spent in closed sessions occupied only about 4 hours. These closed sessions primarily addressed, .the selection of new members and were closed because they involved discussions of internal agency management and personnel practices,,and information the release of which would have constituted a clearly unwarranted invasion of personal privacy if made public. i M 1
