Proposed Permit (s) under the National Pollutant Discharge Elimination System.

The permit (s) will become effective 30 days from the date of this Public Notice.

Any substantial changes from the Draf t Permit are cited.

This issuance is based on a final staff review of the administrative record and concents received. A Response to Comments is available by writing to:

The original public notice contains the stay provisions of a granted evidentiary hearing request.

NPDES authorization to discharge to waters of the United States, Permit No. LA0042731 The applicant's mailing address is : Gulf States Utilities Company P.O. Box 220 St. Francisville, Louisiana 70775 The discharges from this existing discharger are made into the liississippi River, a water of the United States classified for primary and secondary contact recreation and propagation of fish and wildlife. The discharges are located on that water near St. Francisville, West Feliciana Parish, Louisiana. Under the standard industrial classification (SIC) code 4911, the applicant's activities are electrical power generation at the River Bend Station.

The Louisiana Department of Environmental Quality, as a conditon of certi-  !

fication, requested that fecal coliform and chlorine limitations be included  !

at sanitary Outf alls 004 and 005.

Response No. 1 The proposed permit was in response to GSU's May 25, 1988, modification ,

- request, which asked that a metal cleaning outfall be added to the permit.

GSU's request was included in the proposed permit as Outf all 102. The Louisiana Department of Environmental Quality did not have any comments on Outfall 102. ,

When a permit is modified, only the conditions subject to modification are >

reopened (40 CFR 122.62). The conditions for Outf all 004 and 005 were not reopened in the proposal. Therefore, the Agency cannot grant LDEQ's request at this time, in addition, it was noted that the pages appended to the LDEQ letter contained fecal coliform reporting requirements and not fecal coliform limitations per se.

i SECTION B. SCHEDULE OF COMPLIANCE The permittee shall achieve compliance with the effluent limitations specified for discharges in accordance with the following schedule:

NONE Reports of compliance or noncompliance with, or any progress reports on, interim and final requirements contained in any compliance schedule of this permit shall be submitted no later than 14 days following each schedule date. Any reports of noncompliance shall include the cause of noncompliance, any remedial actions taken, and the probability of meeting the next. scheduled requirement.

! i PART II STANDARD CONDITIONS FOR NPDES PERMITS

'SECTION'A. GENERAL CONDITIONS

1. Duty to Comply r The permittee must comply with all conditions of this permit. Any permit noncompliance constitutes a. violation of the Clean Water Act and is grounds for enforcement action; for permit termination, revocation and .

reissuance, or modification; or for denial of a permit renewal application.

2. Penalties for Violations of Permit Conditions The Clean Water Act provides that any person who violates a permit  ;

condition implementing Sections 301, 302, 306, 307, 308, 318, or 405 of the Clean Water Act is subject to a civil penalty not to exceed $10,000 per day of such violation. Any person who willfully or negligently violates permit conditions implementing Sections 301, 302, 306, 307, or '

308 of the Clean Water Act is subject to a fine of not less than 32,500 nor more than 525,000 per day of violation, or by imprisonment for not more than 1 year, or both.

3. Permit Actions This permit may be modified, revoked and reissued, or terminated for i cause including, but not limited to 'the following:
a. Violation of any terms or conditions of this permit;
b. - Obtaining this permit by misrepresentation or failure to disclose-fully all relevant f acts;
c. A change in any condition that requires either a temporary or a -

permanent reduction or elimination of the authorized discharge; or, 1

d. A determination that the permitted activity endangers human health _i or the environment and can only be regulated to acceptable levels by '

permit modification or termination. )

The filing of a request by the permittee for a permit modification, revocation and reissuance, or termination, or a notification of planned changes or anticipated noncompliance, does not stay any permit condition.

4. Toxic Pollutants Notwithstanding Part II.A.3, if any toxic effluent standard or prohibition (including any schedule of compliance specified in such effluent standard

~or prohibition) is promulgated under Section 307(a) of the Clean Water Act p for a toxic pollutant which is present in the discharge and that standard

? cr prohibition is more stringent than any limitation on the pollutant in this permit, this permit shall be modified or revoked and reissued to conform to the toxic effluent standard or prohibition and the permittee so notified.

The permittee shall comply with effluent standards or prohibitions established under Section 307(a) of the Clean Water Act for toxic ,

pollutants within the time provided in the regulations that established those standards or prohibitions, even if the permit has not yet been i modified to incorporate the requirement.

5. ' Civil and Criminal liability -

Except as provided in permit con'itions on " Bypassing" (Part II.B.4.b) and " Upsets" (Part II.B.S.b), nothing in this permit shall be construed to relieve the permittee from civil or criminal penalties for noncompliance.

6. Oil and Hazardous Substance Liability Nothing in this permit shall be construed to preclude the institution of any legal action or relieve the permittee from any responsibilities, liabilitf es, or penalties to which the permittee is or may be subject under Section 311 of the Clean Water Act.
7. State Laws Nothing in this permit shall be construed to preclude the institution of any legal action or relieve the permittee from any responsibilities.

9. Severability s

The provisions of this pemit are severable, and if any provision of this permit or the application of any provision of this permit to any ,

circumstance is held invalid, the application of such provision to other circumstances, and the remainder of this permit, shall not be affected thereby.

10. Definitions .

-The following definitions shall apply unless otherwise specified in this permit:

a. " Daily Discharge" means the discharge of a pollutant measured ,

during a calendar day or any 24-hour period that reasonably represents the calendar day for purposes of sampling. For pollutants with limitations expressed in terms of mass, the " daily discharge" is calculated as the total mass of the pollutant discharged over the sampling day. For pollutants with limitations expressed in other units of measurement, the " daily discharge" is calculated as the average measurement of the pollutant over the sampling day. " Daily discharge" determination of concentration made using a composite sample shall be the concentration of the composite sample. When grab samples are used, the " daily discharge" determination of concentration shall be the arithmetic average (weighted by flow value) of all samples collected during that sampling day,

b. " Daily Average" (also known as monthly average) discharge limitation means the highest allowable average of " daily discharges" overL a calendar month, calculated as the sum of all " daily discharges" measured during a calendar month divided by the number of " daily discharges" measured during that month. When the permit establishes daily average concentration effluent limitations or conditions, the daily average concentration means the arithmetic average (weighted by flow) of all " daily discharges" of concentration determined during the calendar month,
c. ")aily Maximum" discharge-limitation means the highest allowable "siaily discharge" during the calendar month.
d. The tem "MGD" shall mean million gallons per day.
e. The term "mg/l" shall mean milligrams per liter or parts per million (ppm).
f. The term "ug/l" shall mean micrograms per liter or parts per billion (ppb).

L-SECTION B. OPERATION AND MAINTENANCE OF POLLUTION CONTRU S

1. Proper Operation and Maintenance The permittee shall at all times properly operate and maintain all facilities and systems of treatment trd control (and related appurtenances) which are installed or used by the permittee to achieve compliance with the conditions of this permit. Proper operation and maintenance also l includes adequate laboratory controls and appropriate quality assurance procedures. This provision requires the operation of backup or auxiliary f acilities or similar systemt which are installed by. a permittee only when the operation is necessary to achieve compliance with the conditions of the permit.

-2. Need to Halt or Reduce not a Defense It shall not be a defense for a permittee in an enforcement action that it would have been necessary to halt or reduce the permitted activity in order to maintain compliance with the conditions of this permit.

3. Duty to Mitigate The permittee shall take all reasonabie steps to minimize or prevent any discharge in violation of this permit which has a reasonable likelihood of adversely affecting human health or the environment.
4. Bypass of Treatment Facilities
a. Definitions (1) " Bypass" means the intentional diversion of waste streams from any portion of a treatment facility.

(2) " Severe property damage" means substantial physical damage to property, damage to the treatment facilities which causes them to become inoperable, or substantial and >

permanent loss of natural resources which can reasonably be expected to occur in the absence of a bypass. Severe property damage does not mean economic loss caused by delays in production.

b. Bypass not exceeding limitations. The permittee may allow any bypass to occur which does not cause effluent limitations to be exceeded, but only if it also is for essential maintenance to assure efficient operation. These bypasses are not subject to the provisions of Part II.B.4.c and 4.d.

c. Notice (1) Anticipated bypass. If the permittee knows in advance ,

of the need for a bypass, it shall_ submit prior notice, if possible at least ten days before the date of the ,

bypass.

(2) Unanticipated bypass. The permittee shall submit notice of an unanticipated bypass as required in Part II.D.6 (24-hour notice),

d. Prohibition of bypass (1) Bypass is prohibited, and the Directer may take enforcement action against a permittee for bypass, unless:

(a) Bypass was unavoidable to prevent loss of life..

personal injury, or severe property damage; (b) There were no feasible alternatives to the bypass, such as the use of auxiliary treatment- facilities, retention of untreated wastes, or maintenance during normal periods of equipment downtime. This condition is not satisfied if adequate back-up equipment should have been installed in the exercise of reasonable ,

engineering judgment to prevent a bypass which occured  ;

during normal periods of equipment downtime or preventive maintenance; and, (c) The permittee submitted notices as required by l Part II.B.4.c.

(2) The Director may approve an anticipated bypass, after considering its adverse effects, if the Director determines that it will meet the three conditions listed at Part II.B.4.d.(1).

5. Upset Conditions 1
a. Definition. " Upset" means an exceptional incident in which there 1 is unintentional and temporary noncompliance with technology-based  !

permit effluent limitations because of factors beyond the reasonable l control of the permittee. An upset does not include noncompliance to the extent caused by operational error, improperly designed treatment facilities, inadequate treatment facilities, lack of preventive maintenance, or careless or improper operation.

b. Effect of an upset. An upset constitutes an affirmative defense to an action brought for noncompliance with such. technology-based permit effluent limitations if the requirements of Part II.B.5.c are met. _ No determination made during administrative review of  ;

claims that noncompliance was caused by upset, and before an action for noncompliance, is final administrative action subject to judicial review.

c. Conditions necessary for a demonstration of upret. A permittee who wishes to establish the affirmative defense of upset'shall demonstrate, through properly signed, contemporaneous operating ,

logs, or other relevant evidence that:

(1) An upset occurred and. that the permittee can identify the cause(s) of the upset; (2) The permitted facility was at the time being properly

- ope ra ted ;-

(3) The permittee submitted notice of the upset as required by Part II.D.6; and, (4) The permittee complied with any remedial measures required by Part II.B.3.

d. Burden of proof. In any enforcement proceeding the permittee seeking to establish the occurrence of an upset has the burden of proof.
6. Removed Substances Solids, sludges, filter backwash, or other pollutants removed in the course of treatment or control of wastewaters shall be disposed of in-a manner such as to prevent any pollutant from such materials from entering navigable waters.

b SECTION C. MONITORING AND RECORDS

1. Representative Sampling

- Samples.and measurements taken as required herein shall be representative of the volume and natare of the monitored discharge. All samples shall be taven at the monitoring points specified in this permit and, unless otherwise specified, before the effluent joins or is diluted by any other wastestream, body of water, or substance. Monitoring points shall not be changed without notification to and the approval of the Director.

2. Flow Measurements Appropriate flow measurement devices and methods consistent with accepted scientific practices shall be selected and used to ensure the accuracy and reliability of measurements of the volume of monitored discharges.

The devices shall be installed, calibrated, and maintained to insure that the accuracy of the measurements are consistent with the accepted capability of that type of device. Devices selected shall be capable of measuring flows with a maximum deviation of less than + 10% from true discharge rates throughout the range of expected discharge volumes.

3. Monitoring Procedures >

Monitoring must be conducted according to test procedures approved under 40 CFR Part 136,_ unless other test procedures have been specified in this permit.

4. Penalties for Tampering The Clean Water Act provides that any person who falsifies, tampers with, or knowingly renders inaccurate, any monitoring device or method required to be maintained under this permit shall, upon conviction, be punished by a fine o_f not more than $10,000 per violation, or by imprisonment for not more than 6 months per violation, or by both.
5. Reporting of Monitoring Results Monitoring results must be reported on a Discharge Monitoring Report (DMR) Form- EPA No. 3320-1. Monitoring results obtained during the previous month shall be sumarized and reported on a DMR form post-marked

6. Additional Monitoring by the Permittee ,

7. Averaging of Measurements Calculations for all limitations which require averaging of measurements '

shall utilize an erithmitic mean unless otherwise specified by the Director in the permit.

8. Retention of Records The permittee shall retain records of all monitoring infonnation, including all calibration and maintenance records and all original strip chart recordings for continuous monitoring instrumentation, copies of all reports required by this permit, and records of all data used to complete that application for this permit, for a period of at least 3 years from -

the date of the sample, measurement, report, or application. This-period may be extended by request of the Director at any time..

9. Record Contents .

Records of monitoring information shall include:

l

a. The date, exact place, and time of sampling or measurements;
b. The individual (s) who performed the sampling or measurements;
c. The date(s) analyses were performed;
d. The individual (s) who performed the analyses;
e. The analytical techniques or methods' used; and, L f. The results of such analyses. .
10. Inspection and Entry g

The pennittee shall allow the Director, or an authorized representative, upon the presentation of credentials and other documents as may be l_

required by law, to:

l~

a. Enter upon the permittee's premises where a regulated facility or activity is located or conducted, or where records must be kept under the conditions of this permit;
b. Have access to and copy, at reasonable ti:nes, any records that must be kept under the conditions of this permit;
c. Inspect at reasonable times any facilities, equipment (including monitoring and control equipment), practices, or operations ,

i regulated or required under this permit; and,

d. Sample or monitor at reasonable times, for the purposes of assuring permit compliance or as otherwise authorized by the Clean Water Act, any substances or parameters at any location. ,

6. - Twenty-Four Hour Reporting l The permittee shall report any noncompliance which may endanger health t or the environment. Any information shall be provided orally within -

A written submissian shall also be provided within 5 days of the time ,

The written submission shall contain a description of the noncompliance and its cause; the period of noncompliance, including exact dates and times, and if the noncompliance has not been corrected, the anticipated time it is expected to continue; and steps taken or planned to reduce,- eliminate, and prevent reoccurrence of the noncompliance. 7. Other Noncompliance The permittee shall report all instances of noncompliance not reported L under Part II.L.4, 5, and 6 at the time monitoring reports are submitted.

l' 8. Changes in Discharges of Toxic Substances The' permittee shall notify the Director as soon as it knews or has

! reason to believe:

a. That any activity has occured or will t.ccur which would result

!< in the discharge, in a routine or frequent basis, of any toxic l pollutant which is not limited in the permit, if that discharge will exceed the highest of the " notification levels" described in 40 CFR Part 122.42(a)(1) [48 FR 14153, April 1,1983, as amended at 49 FR 38046, Septembe F 26, 1984].

b. That eny activity has occured or will occur which would result in any discharge, on a non-routine or infrequent basis, of a toxic pollutant which is not limited in the permit, if that

SECTIOR D. REPORTING REQUIREMENTS -

1. Planned Changes The permittee shall give notice to the Director as soon as possible of any planned physical alterations or additions to the permitted f acility.

Notice is required only when:

a. The alteration or addition to a permitted facility may meet one of the criteria for determining whether a facility is a new source in 40 CFR Part 122.29(b) [48 FR 14153, April 1,1983, as

. amended at 49 FR'38046, Septeter 26 1984); or,

b. The alteration or addition could significantly change the nature or increase the quantity of pollutants discharged. Thi s notificat. ion applies to pollutants which are subject neither to effluent limitations in the permit, nor to notification requirements under 40 CFR Part 122.42(a)(1) [48 FR 14153, April 1,1983, as n amended at 49 FR 38046, Septemer PE 1984).
2. Anticipated Noncompliance The permittee shall give advance notice to the Director of any planned changes in the permitted facility or activity which may result in noncompliance with permit requirements.
3. Transfers L This permit is not transferable to any person except after notice to the Director.- The Director may require modification or revocation and

.s reissuance of the permit to change the name of the permittee and incorporate cuch other requirements as may be necessary under the Clean Water Act.

4. Monitoring Reports Monitoring results shall be reported at the intervals and in the form specified at Part II.C.5 (Monitoring).
5. Compliance Schedules Reports of compliance or noncompliance with, or any progress reports on, interim and final requirements contained in any compliance schedule of this permit shall be submitted no later than 14 days following each schedule date. Any reports of noncompliance shall include the cause of noncompliance, any remedial actions taken, and the probability of meeting the next scheduled requirement.

discharge will exceed the highest of the " notification levels" described in 40 CFR Part 122.42(a)(2) [48 FR 14153, April 1, 1983, as amended at 49 FR 38046. Septerter 76,1984).

9. Duty to Provide Information The permittee shall furnish to the Director, within a reasonable time, any information which the Director may request to determine whether cause exists for modifying, revoking and reissuing, or terminating this permit, or to. determine compliance with this permit. The permittee shall also furnish to the Director, upon request, copies of records required to be kept by this pemit. ,
10. Duty to Reapply If the permittee wishes to continue an activity regulated by this permit af ter the expiration date of this permit, the permittee must apply for and obtain a new permit. The application shall be submitted at least 180 days before the expiration date of this pemit. The Director may grant permission to submit an application less than 180 days in advance but no later than the permit expiration date. Continuation of Partexpiring 122.6 [ 48 permits FRR 14153, shall April be governed by regulations 1, 1983) and promulgated any subsequent amendments. at 40.CFR
11. Signatory Requirements All applications, reports, or information submitted '.o the Director shall oe- signed-and certified.
a. All permit app.lications shall be signed as follows:

(1) For a corporation - by a responsible' corporate officer.

For the purpose of this section, a responsible corporate officer means:

(a) A president, secretary, treasurer, or vice-president ~

of the corporation in charge of a principal business function, or any other person who performs similar policy or decision making functions for the corporation; or, (b) The manager of one or more manufacturing, production, or operating facilities employing more than 250 persons or l'

having gross annual sales or expenditures exceeding $25 million (in second-quarter 1980 dollars), if authority to sign documents has been assigned or delegated to the L manager in accordance with corporate procedures.

(2) For a partnership or sole proprietorship - by a general partner or the proprietor, respectively.

12. Availability of Reports Except for data determined to be confidential under 40 CFR Part 2, all reports prepared in accordance with the terms of this permit shall be available for public inspection at the office of the Director. As required by the Clean Water Act, the name and address of any permit applicant or permittee, permit applications, permits, and effluent data shall not be considered confidential.

13. Penalties for Falsification of Reports The Clean Water Act provides that any person who knowingly makes any false statement, representation, or certification in any record or
  • other document submitted or required to be maintained under this permit, including monitoring reports or reports'of' compliance or noncompliance shall, upon conviction, be punished by a fine of not more than $10,000 per violation, or by imprisonment for not more than 6 months per violation, or by both. -

PART III OTHER CONDITIONS A. There-shall be no discharge of polychlorinated biphenyl transformer fluid.  ;

B.. . The daily temperature shall be computed and recorded en a daily basis as the average in' a 24-hour period of temperatures at intervals not greater than two hours. " Daily average temperature" (also known as average monthly or maximum 30 day value) shall be the arithmetic average of all daily temperatures calculated during the calendar month.

" Daily maximum temperature" (also known as the maximum daily value) shall i be the highest daily temperature calculated during the calendar month.

C. ~ The tem " free available chlorine" shall mean the value obtained using the amperometric titration method for free available chlorine described in the latest edition of " Standard Methods for the Examination of Water and Wastewater."

Neither free available chlorine nor total residual chlorine may be dis--

charged from any unit for more than two hours in any one day and not more than one ur,it in any plant may discharge free available or total residual chlorine at any one time unless the permittee can demonstrate to the

_ permitting Agency that the units in a particular location cannot operate at or below the limitations specified in this pemit.

D. The term " total residual chlorine" (or total residual oxidants for intake water with bromides) means_ the value obtained using the amperometric method for total residual chlorine described in the latest edition of'

" Standard Methods for the Examination of Water and Wastewater."

E. Provisions shall be made to contain runoff from construction material storage areas.

F. As a provision of this permit, the applicant is subject to the L requirements of PL-92-500, Section 316(b).

G. Where more than one source is associated with a particular waste category these chn be analyzed and reported individually or combined into single flow weighted sample for analysis and reporting.

H. Water treatment clarifier sludge wastes may be returned to the stream without treatment if not previously combined with any other untreated waste sources including demineralizer and softner wastes.

1. There shall be no discharge of cooling tower maintenance chemical which contain the 129 priority pollutants (Appendix b of 40 CFR, Part 423).

J. On the effective date this permit shall supersede NPDES Pemit No.
