In the Matter of HOUSION LIGRIING ABO POLE CCNPANY Allens Creek Nuclear Generating Station, Unit 1 Docket No. 50-466 CP

h. Cuse Stephens has brought to my attention that three intervening parties, Yessrs. Doherty, Schuessler and Potthoff, have respectively sub:d.tted a single copy of docunent(s) to the Chief, Docketing and Service Branch and indicated that, pursuant to the Comission's amended regulations, said docu-aent(s) should be served free of charge upon the other parties in this roceed-ing. Mr. Stephens advised that he had telephoned &. Doherty on Septem:er 8, W. Sc nessler on Septeber 10 and &. Potthoff on September 12, 1980, and, in t

substance, told them that he could not copy and serve their submissions because said s M=sions were not covered by the amended procedural assistance regula-tions, that he was returning these siMesions for proper service upon the parties and the Board, and that he was furnishing a copy of the revised regula-ticas. Further, W. Stephens specified the three types of sub ssions that, pesuant to 10 C.F.R. 2.712(f), as amended, would be copied and served free of charge by the Docketing and Service Branch - i.e. a party's written testinony (inclu: ling attachments), proposed findings of fact and conclusions of law, and responses to discovery requests.

Stephens was "unsr e" what documents were to be served free of charge by the Do:keting and Service Branch. Further, as is clearly stated at 45 Fed. Reg. 49535, 49536, the x a,ht to 8 2.708(d) merely reduces the number of copies of do:monts that cust be filed with the Docketing and Service Branch for internal distribu~ ion purposes.

The Intervenors are warned that they cost read our Rules of Practice and any a enients thereto, and that any failure to do so will not be pennitted to delay dese proceedings. A copy of these amendments, 45 Fed. Reg. 49535, at ached to c= 0:dar of July 31, 1980 was served upon all parties, and no one quasti ned t':=#- ~~e s dring the prehearing conference en August 13, 1980.
