MEMORANDUM AND ORDER (September 23, 1980)

ANGRY's September 15, 1980 request for an extension of time to file the written direct testimony of Dr. Jan Beyea on ANGRY Contention V(D) was discussed in a telephone conference call on September 22 among counsel for ANGRY, counsel for the licensee, counsel for the NRC staff and the chairman.

ANGRY's counsel discussed briefly the nature of the testimony expected l

from Dr. Beyea and his qualifications.

While the board does find that ANGRY has demonstrated good cause for failing to not file the testimony by its due date of September 15, counsel did provide a better explanation for the late filing.

Moreover, the board itself wishes to consider Dr. Beyea's testimony, and, with ANGRY's agreement to serve the testimony on or before October 3 (rather than November 1 as origiaally requested), it does not appear that the proceeding will be delayed by the late filing.

a k Therefore, over licensee's obj ections, the time during which ANGRY may file the direct testimony of Dr. Beyea is extended to October 3, 1980.

Counsel for licensee and counsel for the staff may submit to the board their respective cross-examination plans on Dr. Beyea's testimony on October 15.

The board will also consider other appropriate requests for relief from the licensee and staff if the lateness of ANGRY's filing prejudices them.
