Dear Mr. Helfrich:
Enclosed please find an application from RMI Company, Extrusion Plant, for a license to export 11,340 kilograms of depleted uranium solid metal to Eldorado Nuclear in Canada to be machined into fuel pins.
In response to NRC's request for additional information on the disposition of the fuel pins, Eldorado advised RMI Company that the fuel pins will be shipped to NUKEM, West Germany, for further fabrication, including aluminum cladding of the pins, and then reexported to the Iraq Atomic Energy Commission, Nuclear Research Centre, Tuwaitha, Baghdad, where, according to the appli-cation, they will be used in a subcritical assembly for research and training purposes.
RMI will supply written confirmation of this additional information which will be forwarded to you upon receipt.
Before taking action on this license application, we would appreciate your views, in accordance with established procedures and from the overall perspective of the Executive Branch, as to whether the proposed export meets the applicable criteria in the Atomic Energy Act as amended by the Nuclear Nonproliferation Act of 1978.
