SETTLEMENT STATUS REPORT OF DEPAP,TMENT OF JUSTICE On August 13, 1980, the Licensing Board issued an order requiring the parties to file status reports on September 12, 1980, including proposed settlements on license conditions, un-resolved issues, and suggestions for hearing procedures. The Department of Justice (" Department") hereby submits this settle-ment status report in compliance with that order.

Since its last status report, filed with the Licensing Board on July 11, 1980, the Department has engaged in extensive set-tiement discussions with the parties in an effort to agree on specific license conditions for the South Texas Nuclear Project and the Comanche Peak Steam Electric Station.

I The Department is pleased to report that, with respect to the Comanche Peak proceedings, it has reached an agreement with the partles regarding a proposed set of license conditions. The Department believes that if these conditions are attached to the operating license in Comanche Peak, that the issuance of an 8009180 g g

4 5 7 operating license will not create or maintain a situation in-consistent with the antitrust laws or their underlying policies under Section'105c of the Atomic Energy Act of 1954, as amended.

With respect to the South Texas proceeding, the Department l has reached an agreement with the Applicants in that proceeding regarding a proposed set of license conditions. 1/ However, the other parties to the South Texas proceeding have not yet had the opportunity to review the settlement license conditions be-cause they were finalized only late yesterday. Accordingly, the Department believes tnat the Licensing Board should grant those parties an additional period of time in which to* review the set-tiement license conditions in order that they might fulfill their obligations under the Licensing Board's Order of August 13, 1980, which directs all of the parties, inter alia, to sub-mit their views on the proposed settlement. Thereafter, the Board should establish such procedures as it deems appropriate to determine whether it should approve the proposed settlement license conditions in the South Texas proceeding.

1/ The Department understands that the agreement of the City of Austin and.the Public Service Board of San Antonio regarding the proposed settlement license conditions is, as of this moment, a tentative agreement subject ~to the review of the final draft of the proposed conditions and necessary approvals by those

municipalities. Attached to the Staff's Fourth Status Report on Settlement is a copy of the proposed Stipulations in these proceedings to be signed by the parties. Due'to the press of time, however, the Department believes that a fully executed Stipulat. ion cannot be presented to the Board until Monday, September'15, 1980.
