1. Original contentions TexPIRG A16 .(d),(e), (f), (1) and A42; Doggett 5; and Schuessler 6 and 14 have been admitted as litigable issues

. 2. Consolidated language attempts only to preserve those admitted issues

3. Consolidated language does not inject new issues nor does it enlarge on admitted issues
4. Since all issues have already been admitted, new language cannot raise challenge to Commission Rules
5. Intervenors have simply complied fully with Order of Board Intervenors believe Applicant and Staff are attempting to appeal a ruling of the presiding officer, which is expressly pro-hibited by Part 2, Rules of Practice, Sec. 2.730 (f).

If, despite all of above, the Board sees a genuine problem l

, in_use of consolidated language, Intervenors suggest that admitted contentions, as, written, remain in litigation to resolve problem.
