Dear Mr. Burnett:

My letter of J'une~18 conf'irmed the change in Texas'Instrumenta status as a supplier-of nuclear fuel elements and requested a-slight delay in filing our Plan for compliance with the Physical Protection Upgrade Rule.

This letter is being sent to request your assistance in another matter affecting the NRC, specifically TI's Renewal Application for License SNM-23 On February 15, 1979, we forwarded the Renewal i

Application to NRC.

Sub'sequently we received responses from your staff and replied with revisions by letters of August 29 and September 6, 1979 By letter of May 12, 1980, Mr. Ketzlach advised an initial review of the revised application had been-completed, that additional information was required, and that final formal

responses are due no later than August 22, 1980.

With respect to minor changes and/or. clarifications to our Renewal Application, we have no problem meeting the August 22 date; however there are parts of the NRC request that require extensive engineering calculations beyond Texas Instruments' capability.

In order to perform those highly-theoretical calculations, we would need either to hire a renowned axpert or to arrange for some consulting agreement with a DOE expert.

Considering our short tenure in this business, the first alternative becomes impractical; and, recognizing the impending summer vacation period and peaking i

l of similar needs by other licensees, our pursuing the latter alternative is incompatible with the August 22 deadline.

Since you already are aware of TI's change in status, I am writing to request your assistance in obtaining an extension of the t,l '(f.'.)

My best estimate of such a date, and therefore this request, is for December 31, 1980.

We are prepared to discuss the date and/or reasons for this request with you but would appreciate hearing from you as quickly as possible to avoid any subsequent complications.
