SCHEDULE FOR 1MI-1 RESTART PROCEEDING At the prehearing conference in the TMI-1 restart proceeding held on May 13, 1980, OELD informed the Licensing Board, on the advice of the technical statf, that the staff would be prepared to go 'to hearing in September 1980 on the first five short-term actions of the Commission's August 9, 1979 Order (Tr. 1806-07). These five items are, in summary, (1) upgrading the reliability of, and implementing procedures for, the emergency feedwater system, installing a reactor grade trip on loss of main feedwater, completing analyses of potential sma11 breaks and retraining reactor operators; (2) comp?eting and obtaining approval of IE Bulletin actions; (3) upgrading emergency precaredness; (4) demonstrating that decontamination and/or restoration operations at TMI-2 will not affect safe operations at TMI-1; and (5) demonstrating the adequacy of the TMI-1 waste management capability.
Recently, it has become separent that the Staff is not prepared and is unable to go to hearing in September 1980 with regard to Order item (3) on emergency preparedness. 03.0 se indicated to the Licensing Board at the prehearing conference on August 12 and 13,1980. In addition, no apparent progress is being made on the resolution of Itydrogen control contentions and Class 9 accident contentions. While these latter insue areas are not among those for which the Staff committed to file testfacq by September 1980, it is clear that hydrogen control and Class 9 acciden*. issues will become, along with emergency preparedness issues, pacing items causing further delay I
in the presentation of the Staff's case if adequate technical msources and manpower are not new committed.to the prompt. resolution of these matten.

Denton Moreover, it should be noted that draft testimony in those issue areas for which testimony is due for filing with the Licensing Board on September'15, 1980 was to be submitted to OELD by July 14, 1980. For a great number of such issues, the Staff had not even begun preparing testimony by July 14.
The draft testimony that was submitted by that date was and still is, by and large, unresponsive and inadequate, requiring substantial revision. In general, the state of the draft written testimony available at this time t
raises some question as to the Staff's ability to file adequate testimony due on September 15, 1980.
l In view of the Commission's August 9.1979 Order on restart of TMI-1 and the delays that have occurred to date. I would appreciate your cooperation in assuring that sny further delays are obviated.
