Western New York Nuclear Service Center, West Valley, New York

Purpose:

To discuss with the co-licensees for the Western New York Nuclear Service Center facility indemnification and liability issues associated with implementation of work by the staff's contractor, Rockwell Hanford Operations, to inspect and evaluate the condition of the high level liquid waste storage system at the facility.

Place and Date: Nuclear Regulatory Commission (NRC), Office of Nuclear Material Safety and Safeguards, Silver Spring, Maryland, July 17, 1980

NMSS and ELD staff met with representatives of NFS and New York State ~ERDA, the co-licensees for the West Valley facility, regarding planned site investigations of the high level waste storage systems by Rockwell-Hanford under NRC contract.

The meeting was held following receipt of letters by the co-licensees from the NRC seeking to initiate the onsite activities without further delay.

NFS had earlier taken a position that prior to granting ' permission for Rockwell to conduct activities at West Valley, appropriate indemnification agreements must be developed.

The involved par ties have agreed +n attempt to negotiate an acceptable solution to the indemnification issue.

If the matter is not resolved soon, the NRC plans to initiate appropriate enforcement action.
