PROPOSED IMPOSITION OF CIVIL PENALTIES - $48,000 This is to inf,orm the Commission that a Notice of Violation and a Notice of Proposed Imposition of Civil Penalties in the amount of Forty-eight Thousand Dollars will be issued on or about August 18, 1980, to the Power Authority of the State of New York. This action is based on items of 1ancompliance associated with the implementation of the FitzPatrick Phjsical Security Plan involving failure to assign security force personnel to the last access control function and the use of untrained security force members to perform this function.

In addition, the licensee failed to maintain the integrity of the vital areas through the use of adequate bariiers, mechanical locks, and card key access control. A news release has been orepared and will be issued about the time the licensee receives the Notices.

The State of New York will be informed.

It should be noted that the licensee has not been specifically informed of the enforcement action.

Following NRC staff evaluation of the response, the civil penalties may be remitted, mitigated or imposed by Order.
