LICENSEE'S RESPONSE TO STAFF'S MOTION TO CONFORM PROPOSED TECHNICAL SPECIFICATICNS IN ACCORDANCE WITH MODIFICATION OF ORDER By Order of the Director, Office of Nuclear Reactor Regulation, dated February 11, 1980, the Commission established a set of formal license regnirements reflecting the post-accident condition of the TMI-2 facility and assuring the continued maintenance of the current safe, stable, long-term cooling condition of the Jacility.
The February 11 Order further provided that the requirements of the proposed Technical Specifications (attached to the Order) were immediately ef fective, with an opportunity for hearing prior to the efrec eiveness of the proposed formal license amendment.
At the time the February 11 Order was issued, both the Staff and Licensee anticipated that, during the 1b
)O pendency of this matter, changes in the proposed Technical B009030I b
. Specifications might be necessary as the facility status evolves as a result of ongoing recovery efforts.
On August 11, 1980, the Deputy Director of the NEC Office i
of Nuclear Reactor Regulation issued a Modification of Order, eliminating the requirements for availability of two balance-of-plant (BOP) diesel generators and an external 13.2 kv transmission line imposed pursuant to the Director's Order of February 11, 1980.
Under the terms of the Modification of Ordar, the two BOP diesel generators and the 13.2 kv transmission line are replaced with an existing 230 kv grid system.
Notice of the August 11 Modification of Order was published at 45 Federal Register 54495-96.
By the August 12, 1980 "NRC Staff Notice of Issuance of Modification of Order and Motion To Conform Proposed Technical Specifications In Accordance Therewith," the Staff has moved that the proposed Technical Specifications attached to the February 11, 1980 Order be formally modified in accordance with the Modification of Order of August 11, 1980, subject to the authority which 10 C.F.R. 2.717(b) reserves to the Licensing Board in this proceeding.
As Licensee understands the Staff's motion, it is simply a request by the Staff that the Board issue an order notifying all parties that the proposed Technical Specifications under consideration in the prospective hearing requested in this proceeding are revised in accordance with the August 11, 1980 Modification of Order (i.e.,
the document before the Board is revised to replace the
. pages 3.8-1, 3.8-2, and 3,9-3 attached to the February 11, 1980 Order with the pages 3.8-1, 3.8-2, and 3.8-3 attached to the August 11, 1980 Modification of Order).
The formal license amendment incorporating the proposed Technical Specifications, as modified, would await the outcome of the prospective hearing.
With this understanding, Licensce does not oppose the motion.
