Handling Systecs, Inc. , Alloy Fcds Divisicn of Allegheny Indit= Industries, Inc. , Alt =irm Ccupany of Arerica, and ._SSCO Corpcraticn, (hereinafter " Petitioners") served upcn de parties in this proceeding en June 13, 1980.

Sesides the factors e:merated in 10 C.F.R. 2.714(d) which de Scard

cust censider in ruling en any petiticn to intervene, dere are five eder factors, set forth in 10 C.F.R. 2.714(a)(1) which rust be ccasidered when the petitien filed is untimely. These facters are

(i) Good cause, if any, for failure to file en tire.

(ii) The availability of other means whereby de petitiener's interest will be protected.

(iii)The extent to which the petiticner's participatien erf reascnably be excected to assist in develeping a scund record.

(iv) The extent to which de petiticner's interest will be represented by existing parties.

(v) "Ihe extent to which de petiticner's participaticn will broaden the issues or delay the preceeding.

l (8) what, if any, conclusions regarding Metropolitan Edison's ability to operate thit 1 safely can be drawn from a conparison of the number and type of past infractions of NRC regulations attributable to the Three Mile Island thits with industry-wide infraction statistics; (9) what, if any, conclusions regarding Metropolitan Ediscn's ability to operate Lhit 1 safely can be drawn frcm a comparison of the nunber and type of past Licensee Event Reports ("LER") and the licensee's operating experience at the Three Mile Island thits with industry-wide statistics on IIR's and operating experience;

, (12) whether Metropolitan Edison possesses the financial rescurces necessary to safely cperate thit 1 in addition to cleaning up thit 2.

These items are matters en which Petitieners, as ccx:panies which Pave experienced extensive environmental regulation ard (in a few cases) litigation, may reasonably be expected to have the kind of expertise available to enable them to centribute to a full and cocplete record. Petitioners niay, of course, be able to hire or accuire experts on other issues, but the Ccamonwealth has no information in that regard.

B. Petitioner's Effect on Breadth of Issues or Delav of Proceedings.

l The Board now has before it the assertion of Petitioners that they desire to expedite, not delay, the proceedings (page 8 of petition) and a descripticn of their positicn (page 5 of petition) in general teres which do not appear 1

to represent any attecpt to broaden the secpe of the proceeding. dbreover, the Board will have the opportunity (if the petiticn is granted) to rule on the secpe and specificity of any cententions filed by Petitieners and to require them to adhere to any schedule which has been established in the proceeding. In short, the Petitioners take the proceedirg as they find it.

Fortunately for Petitioners, the proceeding as they find it includes an SER stich it by its own admission centr. ins an incocplete evaluation of managecient capability issues and the statetient that an SER supplement bcsed l

on "an assesscent of conforrance to the available new and upgraded criteria and standards" will be issued later (SER, page C6-1). The Beard will undoubtedly allow a brief opportunity for disecverf en new material contained in this supplement, and the supplement will apparently not be issued until October (Tr. p 2449-50). By the time that discovery pericd begins, Petiticners (if allowed to intervene) will have had an opportunief to file final contentions, the parties will have had an opportunity to respend, and the Board will have had an vyyucunity to rule cn the contentiens. Een the post-SER supplanent discovery begins, Petitiencrs can be given exactly the same discovery rights as any other party; and all of the parties can file discovery requests en Petiticners as they would on any other intervenor. The core stensive the new information centained in the SER supplement, the core similar Petitioners' positien in this proceeding will be to that of other intervenors having contentiens en the management ccepetence issue. In sunrary, the Cmconwealth envisiens the folicwing schedcle:

1. August 25 -

Last day for filing answers to petiticn to intervene.

2. Septaier 2 - Board rules en petition and gives Petiticners week to file cententions.
3. Septecber 15 - Cententions are received (time has been allcwed fer Board to = ail its ruhng, but Petiticners are required to give actual service to parties by hand carrf ing or other means by this date).
4. Septa er 29 - All answers to cententiens are filed.
5. October 1 - SER supplecent is issued by SRC.
6. October 3 - All answers to cententiens are ruled upcn by Board.
7. October 6 - SER Supplement is received by parties and disecvery begins.
