Dear Mr. Frank:

Thank you for taking the time to meet with Mr. Lubenau on July 16,1980 to discuss the results of our review of the.0regon Department of Energy's regulatory program for uranium mills and tailings. We also appreciated the opportunity to meet with Mr. Goddard and Mr. Pollock and their cooperation in this review meeting.

, As a result of the meeting, several comments were offered which, we believe, if carried out, would strengthen your program for regulating uranium mills and tailings.

1.

We believe further definition of the Oregon 00E oversight and coordination with other State agencies will be needed. This should include statements and responsibilities for issuance of radioactive materials licenses, inspections (including radiation safety and tailings dams), routine enforcement actions and escalated enforcement actions (orders, civil penalties, etc.).

2.

Similarly, plans for responding to emergencies at a licensed mill should be developed so that responsibilities of the various State agencies are spelled out including for such things as radiological monitoring and assessment, transportation to the site, press releases, issuance of Orders, etc.

3.

We recomend development of internal license / permitting procedures and inspection procedures to assure consistency and to provide technical guidance to the staff. We will be pleased to work with your staff in this regard.

I would appreciate your response to these comments and to my letter of April 4, 1980, and Mr. Ryan's letter of July 22. An additional copy of this letter is enclosed which should be made available for review by the public.
