Dear Mr. Schumann:

This letter and a copy of the letter to Dr. Edwards, copy enclosed, confirms the comments made to you regarding 'he recent regulatory program review held by Mr. Kendig and Mr. Gordon.

Our discussions with your staff indicated that there is some lack of understanding as to who in the Radiation Control Unit can issue emergency orders. We recomend that these be made known to the staff and such information be included in the

" Enforcement Manual" that was recently prepared.

We also noted that a listing of phone numbers is available to the staff of persons to call for assistance on issuing emergency orders. However, members of the State's legal staff could not be identified. We suggest such individuals also be added to the phone list.

Our review also consisted of a visit to the Brunswick office to discuss operations conducted from that office. The staff member at Brunswick appears to be conducting a good operation with minimal direction.

However, as we stated in the last two reviews, we believe that there is a need to establish more direct administrative control over the Brunswick operations. We realize that frequent meetings are held and phone calls placed between the personnel of the two offices, status reports are prepared, and copies of licensing guides, inspection guides and policy memos are maintained in the Brunswick office. We also recommend that a guide or directive be developed which instructs the Regional office of its responsibilities and directs how the office will operate in all aspects of regulatory matters. We continue to believe that oversight functions by the Atlanta office should be performed through periodic review of selected licer: sing actions and inspection and investigative reports. Copies of license and compliance files as well as license applications should be maintained at the Atlanta office.

We also recomend that minutes of meetings, between members of the two offices, be prepared and placed on file in both offices. We believe that the State is fortunate in having capable personnel administering the day-to-day regulatory operations in the Brunswick and Atlanta offices.

As was covered in our detailed file review with you and Mr. Simanis, we did note some tendencies towards periodic weaknesses in licensing and incident investigation procedures. We believe the two regulatory functions can be enhanced by preparing and using licensing check-off sheets for each type or category of license and by preparing a written set of instructions or procedures for conducting investigations of incidents which cover radiological health and safety.

Mr. Wayne Schumann Details of the inspector accompaniments were presented to Mr. Simanis. As a result of the accompaniments, we recommend that the two new inspectors accompanied enroll in the NRC's inspection procedures course. We also encourage their enrollment in the other NRC courses as we understand they will also be involved in the licensing process.

During the review it was noted that the staff operates a good radiation survey instrument calibration program. The staff should be commended for this effort.

I would appreciate your review of our findings and would like to receive your comments on them.

I am enclosing a copy of a letter to Dr. Edwards with other recommendations on the program.
