Dear Mr. Helfrich:

Enclosed please find an application from General Atomic Company for a license to export specially designed parts and components, valued at $50,000, to Austria for use in the TRIGA Mark II research reactor.

We are unable to issue a license for this export request because criterion 3 of Section 110.42(b) of our licensing regulations for the export of nuclear equipment has not been met.

NRC advised the applicant that items listed in 10 CFR 110 Appendix A (a)(2)(3) and (8) require a utilization license as these are major components of a nuclear reactor.

The applicant has informed us that none of the components proposed for export fall in these categories which would require a utilization facility license.

We would appreciate your contacting the Government of Austria with respect to obtaining the recessary assurance that no retransfers will be permitted without prior U.S. app al. Upon receipt of this assurance, we will be able to issue a license for this proposed export.
